RESOLUTION 02-113
APPROVING PLAT OF SURVEY FOR SPIRIT OF THE HORSE SUBDIVISION
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,Dick Grieme and Doug Pooch presented the Plat of Survey for Spirit of the
Horse Subdivision to the Planning and Zoning Commission;AND,
NOW THEREFORE BE IT RESOLVED by the City Council of Waukee,a duly
incorporated City within Dallas County,Iowa in session this 5th day of August 2002 that
it hereby approves Plat of Survey for Spirit of the Horse Subdivision.

WHEREAS,the property in question is located within two miles of the city limits of
Waukee,Iowa;AND,
WHEREAS,the Planning and Zoning Commission granted approval of the Plat of
Survey contingent on completion of several items.These items have been addressed;
AND,
WHEREAS,The City of Waukee has negotiated with the Owner of the property a pre-
annexation agreement,AND,
WHEREAS,The easements shown on the subdivision plat will be vacated by the City of
Waukee if the property is annexed without approval of the pre-annexation agreement.
