RESOLUTION 02-117
APPROVING THE ACCEPTANCE OF ACKNOWLEDGEMENT/SETTLEMENT
AGREEMENT BETWEEN CASEY'S GENERAL STORE #2179 AND THE IOWA
ATTORNEY GENERAL'S OFFICE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,On June 27,2001,Casey's General Store #2179 was cited with a violation of
Section 453A.2(1)which states that a person shall not "sell,give,or otherwise supply any
tobacco,tobacco products or cigarettes to any person under eighteen years of age;AND,
WHEREAS,Iowa Code section 453A.22(2)(a)provides that if a permit holder or employee of a
permit holder has violated Iowa Code section 453A.2(l),the permit holder shall be assessed a
civil penalty of three hundred dollars ($300.00)for a first violation ofIowa Code Section
453A.2(1);AND,
WHEREAS,the Attorney General's Office has prosecuted this violation on behalf ofthe Iowa
Department of Public Health and the Iowa Alcoholic Beverages Division;AND,
WHEREAS,Casey's Marketing Co./DBA Casey's General Store #2179 has decided to pay the
mandatory $300 civil penalty and sign the Acknowledgement /Settlement Agreement,which
will satisfy the penalty for the violation,which is counted as a first violation under Iowa Code
section 453A.22(2).
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
19th day of August 2002 that it hereby approves the Acceptance of Acknowledgement/Settlement
Agreement between Casey's General store #2179 and the 10 Attorney General's 0 lee.
