RESOLUTION 02-118 I
APPROVING THE FINAL PLAT FOR VILLE D'AVRAY
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Corporation;AND,
WHEREAS,the Developer,J.L.Tucker,and Brad Cooper with CEC presented the final plat for
Ville D'Avray which was unanimously approved by the Planning and Zoning Commission on
May 14,2002 contingent on the following issues being addressed:
1)the Homeowner's Association covenants including tree maintenance along the south
side of Place D'Avray are drafted and provided to the City Attorney for review and approval;
2)a park fee of$I,OOO.OO and the Eastern Area Pump Station connection fee is to be paid
to the City.
NOW,THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
19th day of August 2002 that it hereby approves the Final Plat for Ville D'A vray with the
addition ofthe following changes to the covenant of the homeowners association:
(1)changing the wording of the first sentence of the section on Utilities so that it reads:
"All utility connection facilities and services shall be installed underground."
(2)changing the effective date in the first sentence of the section on Modification of
Restrictions so that the covenauts,restrictions aud provisions of this instrument shall be deemed
covenants running with the laud aud shall remain in full force aud effect until August 1,2032
A.D.instead of August 2,2012 A.D.
And with the addition of the following requirement
(3)the developer has agreed to provide the city with the correct documentation for the
