APPROVING CONTRACT AND WAIVER WITH ALL PROPERTY OWNERS
AND LIENHOLDERS FOR C.W.TAP SInEW ALK PROJECT
INTHENAMEANDBYTHEAUTHORITYOFTHECITYOFWAUKEE,IOWA
WHEREAS,Chuck Wells owner of the building and lot located at 115 N Warrior Lane
has agreed to construction of approximately 193 linear feet of 6 foot wide,4 inch thick,
Portland cement concrete sidewalk,grading and miscellaneous associated work on Lot 4
of Enterprise Business Park Plat 1 (except S 125')at a preliminary cost of $6,299.07;
AND,
WHEREAS,Mr.Wells has also agreed to being assessed for the construction of said
sidewalk;AND,
WHEREAS,Attorney Bob Helmick of Dorsey &Whitney has indicated given that the
project involves one property owner and construction costs will be less than $25,000,the
city could utilize a contract and waiver agreeing to assessment of the fmal cost and
waiving the limitation provided in Section 384.62 where an assessment may not exceed
25%of the value of the property being assessed;AND
WHEREAS,this contract and waiver must be signed by all lienholders as well as the
property owner.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in
session this ih day of October 2002 that it hereby approves the contract and waiver with
Chuck Wells and all lienholders for C.W.Tap Sidewalk Project subject to the condition
that all property owners /lienholders sign the contract and waiver and also that the
contract as approved is not changed.
