Home My WebLink About2002-11-18-Resolutions 02-180_Immanuel Lutheran Church - Sewer Line AgrTHE CITY OF WAUKEE,IOWA RESOLUTION 02-180 APPROVING IMMANUEL LUTHERAN CHURCH -CITY OF WAUKEE SEWER LINE AGREEMENT IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA WHEREAS,the Immanuel Lutheran Church (Church)and City of Waukee (City)hereby agree that there is a requirement for the installation of a sanitary sewer line,and any and all equipment including,but not limited to,a grinder pump,lift station,and other appurtenances for the disposition of sewage from the respective properties of Church and City;AND, WHEREAS,Church and City agree that there is some mutual benefit to the installation of a single sanitary sewer line over,across and through property adjacent to the properties owned by Church and City,through a perpetual easement granted to the benefit of the City;AND, WHEREAS,Church and City will agree to a division of50%-50%for the costs of the acquisition of the perpetual easement,installation of the sanitary sewer line and all necessary equipment or appurtenances thereto to make said sanitary sewer line and the necessary equipment functional to dispose of the sewage from the properties owned by Church and City. The costs shall be first approved by Church and City in order to determine the exact amount of the division between Church and City;AND, WHEREAS,the payment of said costs shall be paid within thirty (30)days after City shall notify Church,in writing,as to the acquisition costs and subject to City having built the sanitary sewer line and appurtenances,through the perpetual easement referred to herein,and said line and appurtenances having been dedicated as a public improvement to the City.
