RESOLUTION 02-192
APPROVING OPTION TO PURCHASE LAND;ACQUISITION OF LAND FOR
RECREATIONAL PURPOSES
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee wishes to purchase land for the purpose of future recreational
use;AND,
WHEREAS,an Option to Purchase Land has been granted to the City of Waukee by Estella L.
Copeland,Trustee of the Estella L.Copeland Trust and Estella Copeland and J.Harry Copeland,
Co-Trustees ofthe Ralph C.Copeland Trust and such land is described as:
The Northwest Quarter of the Southeast Quarter (NWY.SEY.);and
the Southwest Quarter (SWY.)of Section 36,Township 79 North,
Range 27 West of the 5th P.M.,Dallas County,Iowa,together with
all of the land south of the Southwest Quarter of said Section 36
lying adjacent to and North of 300th Street;AND,
WHEREAS,such land is to be purchased in 40 acre tracts beginning with a purchase of the
Southwesterly most 40 acres in 2004,Northwesterly most 40 acres in 2006,Northeasterly most
40 acres in 2008 and 40 acres between Northeasterly and Northwesterly parcels and the
Southeasterly most 40 acres;AND,
WHEREAS,a temporary easement through Parcel A to Parcel B will be granted to the
sellers/owners so that Parcel B can be farmed until such time as Parcel B is purchased by the
City;AND
WHEREAS,the city attorney and staff have reviewed the Option to Purchase Land and agree to
the conditions and terms set out in the document.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
16th day of December 2002 that it hereby approves the Option to Purchase Land for recreational
purposes and approves the temporary easement from Lot A to Lot B.~tJ:.(?/0.
