APPROVING ANNEXATION OF THE BRUMMETT ACRES SUBDIVISION IN ONE
YEAR AFTER APPROVAL OF THE PRELIMINARY PLAT OR AT THE TIME OF
HUNTER HOLLOW ANNEXATION,WHICHEVER COMES FIRST
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,a request to permit a lot-split or subdivision of a property in Hunter Hollow was
presented to Planning &Zoning;AND,
WHEREAS,the subdivision or lot-split into two lots is one that is consistent with the type of
development which exists in the Hunter Hollow area;AND,
WHEREAS,the issue of concern to John Brummett,owner of the land to be divided,is the
city's request that annexation occur at the time of subdivision of the land;AND,
WHEREAS,Mr.Brummett is requesting annexation occur five years after approval of the
subdivision or at the time of annexation of Hunter Hollow,whichever comes first;AND,
WHEREAS,staff have recommended and city policy has been informally created that a request
for a subdivision of property is accompanied by an annexation of that property in to the City;
AND,J
WHEREAS,Mr.Brummett asked Planning &Zoning for a one time variance from that policy,
which was granted by a 4 to 3 vote during the 07-27-04 meeting to permit annexation within ~
~one year (amendment to the resolution approved by 4 ~1 vote)rather than at the time of
subdivision approval.
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this
2nd day of August 2004 that it hereby approves annexation of the Brummett Acres Subdivision
in one year after approval of the prelinrinaryplat or at the time of Hunter Hollow Annexation,
whichever comes first.
BE IT FURTHER RESOLVED that approval of this request to vary from the policy of
annexation at the time subdivision is granted is not considered a precedent in the event of future
requests for subdivision of small properties in the area within two miles of any city limits
contiguous to existing city boundaries.
