APPROVING AND AUTHORIZING EXECUTION OF A
CHAPTER 28E AGREEMENT A UTHORlZING THE PERFORMANCE OF
PHASE II OF A STUDY TO UPDATE THE WRA FACILITIES PLAN
WHEREAS,the WRl\Management Agency authorized the City of Des Moines,Iowa,as
Operating Agency for the WRA (hereinafter "Des Moines"),to retain a consulting engineering
firm to undertake a study of the wastewater conveyance and treatment needs of the Constituent
Communities of the WRl\,hereafter referred to as the Phase I of the WRA Facilities Plan Update;
and
WHEREAS,the WRA Technical Committee,at its meeting on August 15,2000,recommended
that Des Moines,as Operating Agency for the WRA,enter into a consulting contract with
Veenstra &Kimm,Inc.(hereinafter "V&K"or "the consultant")to undertake Phase I of the WRA
Facilities Plan Update;and
WHEREAS,on September 25,2000,the City Council of the City of Des Moines approved and
authorized execution of an Agreement for Professional Services with V &K for performance of
professional services in connection with Phase I of the WRA Facilities Plan Update;and
WHEREAS,on May 18,2001,V&K issued its Preliminary Report,therein identifying those
communities that had determined to participate in the facilities plan study,outlining the proposed
scope of the facilities planning to be conducted on behalf of each such community and on behalf
of those communities jointly,and outlining a proposed methodology for allocating the costs of
said study among those communities;and
WHEREAS,since issuance of said report,the cities of Waukee and Carlisle and Warren County
have also requested to participate in Phase II of the WRA Facilities Plan Update;and
WHEREAS,the cities of Altoona,Ankeny,Bondurant,Carlisle,Clive,Johnston,Norwalk,
Pleasant Hill,Waukee and West Des Moines;the City of Des Moines,both individually and as
Operating Agency of the Des Moines Metropolitan Wastewater Reclamation Authority (\YR.'I.);
the Greenfield PlazaIHills of Coventry Sanitary District;the Urbandale Sanitary Sewer District,
the Urbandale-Windsor Heights Sanitary District,Polk County and Warren County (hereinafter
collectively referred to as the "Participating Communities")have determined that improved
wastewater conveyance and treatment facilities,and additional wastewater conveyance and
treatment capacity,are necessary for the appropriate and efficient conveyance and treatment of
wastewater generated by said Communities and for the proper and orderly development of said
Communities;and

WHEREAS,the Participating Communities have agreed that Des Moines should be authorized to
retain V &K for the purpose of conducting Phase II of the WRA Facilities Plan Update;and
WHEREAS,the Participating Communities have negotiated the terms of a Chapter 28E
Agreement Authorizing the Performance of Phase II of a Study to Update the WR..A Facilities
Plan ("Agreement")for the purpose of (a)formally establishing the scope of the facilities planning
study to be conducted on behalf of each Participating Community and on behalf of them jointly,
(b)authorizing the City of Des Moines to enter into a consulting contract with V &K for purposes
of conducting said study on their behalf,and (c)establishing the methodology for allocating and
billing the costs of said study among the Participating Communities;and
WHEREAS,the City Council for the City of Waukep.,Iowa has been advised and does
believe that it would bein the best interests of the citizens of the City of Wa 11ke e,I ow a to
approve and authorize execution of said Chapter 28E Agreement.
NOW,THEREFORE,BE,At'ill IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WAUKEE ,IOWA
L That the Chapter 28E Agreement Authorizing the Performance of Phase II of a Study to
Update the WRA.Facilities Plan,a copy of which is now on file in the office of the City Clerk and
which by this reference is made a part hereof,is hereby approved as to forin and content.
2,That the Mayor and City Clerk are hereby authorized and directed to execute and attest,
respectively,said Chapter 28E Agreement for and on behalf of the City of
Waukee ,Iowa.
