MINUTES OF THE TUESDAY,JANUARY 13,2004 PLANNING AND ZONING COMMISSION
MEETING.
Chairman Steele called the January 13,2004 meeting of the Planning &Zoning Commission to order
at 7:02 p.m.

Roll Call.Chairman Steele asked for a roll call and the following Commissioners were present:
Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,Steele.Absent:None.Council Representative:
Mertz.
Agenda Approval.Chairman Steele asked if there were any changes to the agenda.None.Motion
by Commissioner Schmidt,seconded by Commissioner Willits,to "Approve the Agenda for January
13,2004."Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion
carried.
Approval of December 23,2003 Meeting Minutes.Chairman Steele asked ifthere were any changes
to the December 23,2003 minutes.None.Motion by Commissioner Willits,seconded by
Commissioner White,to "Adopt the December 23,2003 Meeting Minutes."Ayes:Hoifeldt,Korpanty,
Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission dnring the Open Forum.
Election of Officers for 2004.Motion by Commissioner Hoifeldt,seconded by Commissioner White,
to reelect those officers from 2003.(Chairman -Steele,Vice Chairman -Willits,Secretary -Krantz)]
Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Approve the Revised PD for Legacy Pointe.Jeff Ewing of EWUlg Land Development presented the
Revised PD for Legacy Pointe.Also in attendance was Mike Kastner of Architects Wells Kastner
Schipper.Mr.Ewing explained that the proposed car wash would have translucent,tinted roofing
panels;downcast and fully-shielded interior lighting;and a 30"stone landscaping wall to tie the
proposed outbuildings together and shield the view of the car wash from Highway 6.Chad Weaver
stated that City staff would like to see stonework added to the base of the car wash.Commissioner
Schmidt expressed concern that revisions were being made to a PD after the developer and City had
already entered into a development agreement.Mr.EWUlg explained that the development agreement
was more applicable to the senior housing portion of Legacy Pointe,and not so much the commercial

Approve the Rezoning of a Portion of Parkview Crossing Plat 6 from R-2 (One and Two Family
Residential District)to R-3 (Multi-Family Residential District).Rick Ross,on his own behalf and
that of Jerry and Ron Grubb,presented the Rezoning of a Portion of Park view Crossing Plat 6.Mr.
Ross stated that it had not yet been decided how to develop this property.Commissioner Schmidt
stated that he would abstain from voting due to a possible conflict of interest,as he is cnrrently
building a home through Jerry's Homes.Motion by Commissioner Hoifeldt,seconded by 1
Commissioner Willits,to "Approve the Rezoning ofa Portion of Park view Crossing Plat 6 from R-2 jl
(One and Two Family Residential District)to R-3 (Multi-Family Residential District)."Ayes:Hoifeldt,

Approve the Site Plan for Riekes Material Handling.Tom Howard,president ofRiekes Material
Handling,presented the Site Plan for Riekes Material Handling.Also in attendance were Greg Wattier
of GE Wattier Architecture and Wally Pelds of A.Leo Pelds Engineering.Mr.Howard stated that his
company would be relocating to Waukee from their current facility in northeast Des Moines.He also
explained the nature of the company's business.Mr.Howard stated that the company would not
require any outside storage,and that they hoped to begin construction this spring with a completion
date of October 2004.Chad VI caver explained that the project did not meet the 70%hard surface
requirement for an arterial overlay district,but that only a portion ofthe lot fell within the overlay.He
also stated that City staff found the project acceptable,as it is a well-designed structure that agrees
with the spirit ofthe ordinance as written.Motion by Commissioner Hoifeldt,seconded by
Commissioner White,to "Approve the Site Plan for Riekes Material Handling."Ayes:Hoifeldt,
Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried,
Approve the Site Plan for Williams Pointe Condominiums.Brad Cooper of Cooper Crawford &
Associates presented the Site Plan for Williams Pointe Condominiums.Also in attendance were Mike
Simonson of Simonson &Associates and Chuck Thomas on behalf of Regency Land Company.Chad
Weaver stated that the site plan met the hard surface requirement,and that wainscoting would be added
to those sides of the garages that faced the streets and private drives.Construction is to begin within
one year of City Council approval.Motion by Commissioner Schmidt,seconded by Commissioner
Willits,to "Approve the Site Plan for Williams Pointe Condominiums."Ayes:Hoifeldt,Korpanty,
Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
New Business.The Commission discussed the need to conditionally approve rezoning applications
with proposed uses and developmental tirnelines clearly defined.
Council Representative Mertz introduced himself to the Commission.
Adjournment.Motion by Commissioner Sclnnidt,seconded by Commissioner Willits,to adjourn at
8:13 p.m.Ayes:Hoifeldt,Korpanty,Krantz,Sclnnidt,Willits,White,Steele.Nays:None.Motion
carried.
