Chairman Hoifeldt called the April 24,2007 meeting of the Planning and Zoning Commission to order at 7:00 p.m. Roll Call.Chairman Hoifeldt asked for a roll call and the following Commissioners were present:Hoifeldt, Airhart,Dutcher,Steele,Wilson,Mook,and Schmidt.Absent:None.Others in attendance:Council Representative Mike Watts,Jody Gunderson,Jeff Kooistra,John Gibson,Beth Richardson,Brad Deets,Ben Landbauser,Dennis Dowell,and John Kursitis. Agenda Approval.Motion by Commissioner Schmidt,seconded by Commissioner Airhart,to "Approve the Agenda for April 24,2007."Ayes:Schmidt,Airhart,Wilson,Mook,Steele,Hoifeldt,and Dutcher.Nays: None.Motion carried. Approval of April 10,2007 Regular Meeting Minutes.Motion by Commissioner Wilson,seconded by Connnissioner Steele,to "Adopt the April 10,2007 Regular Meeting Minutes."Ayes:Wilson,Steele,Airhart, Mook,Hoifeldt,Schmidt,and Dutcher.Nays:None.Motion carried. Open Forum.No one appeared to address the Commission during the Open Forum. Motion to Approve the 2007 Amendment to the Waukee Urban Renewal Plan.Director of Connnunity Development,Jody Gunderson briefly explained the amendment to the Waukee Urban Renewal Plan.The 2007 amendment includes the addition of approximately 100 acres in the southwest comer of Waukee,the former City Library Property on 6th Street,approximately 40 acres located south of University Avenue and east of the Waukee Schools Administration Building,and right of way for V Avenue from 312'10Place to Ashworth Road. The City is in the process of working on development agreements and other provisions for all areas included within the proposed Urban Renewal Map Amendment.Motion by Commissioner Steele,seconded by Commissioner Schmidt to "Approve the 2007 Amendment to the Waukee Urban Renewal Plan."Ayes:Steele, Schmidt,Mook,Wilson,Hoifeldt,Dutcher,and Airhart.Nays:None.Motion carried. Motion to Approve the site plan amendment for Sherwin Williams.Chuck Bishop of Bishop Engineering represented the site plan amendment for Sherwin Williams.The purpose of the amendment is to move the proposed frontage road approximately 25 feet further to the south to comply with the minimum requirements of the Department of Transportation for access to the Highway.This revision results in the other revisions to the layout and configuration of the parking lot for the site.The Commissioners expressed concern with the placement of trees at the entrance of the driveway along the frontage road.Motion by Commissioner Schmidt, seconded by Commissioner Dutcher to "Approve the site plan amendment for Sherwin Williams."Ayes: Sclnnidt,Dutcher,Steele,Mook,Wilson,Hoifeldt,and Airhart.Nays:None.Motion carried. Motion to Approve Request for Rezoning for a parcel to be known as Fox Cove (Fox Creek Estates)from R-3A (Owner Occupied Multi-Family Residential District)to PD (planned Development).Mark Lee of Lee Engineering represented the Fox Cove rezoning request.The proposed Planned Development would include 73 single family lots and 60 townhomes.The development is intended to be developed as a private setting including private utilities,private streets,private cornmon open space and a clubhouse.All utilities, streets and amenities would be maintained by a Homeowner's Association.The proposed Planned Development Agreement outlines the minimum requirements of the Planned Development and specifies standards for architectural compatibility,open space treatment and minimum bulk regulations.The Commissioners questioned what was done in other Planned Developments regarding the front yard setback and had discussion regarding the ability to park larger vehicles within the driveway without extending over the sidewalk.Motion by Commissioner Schmidt,seconded by Commissioner Dutcher to "Approve the Request for Rezoning for a parcel to be known as Fox Cove (Fox Creek Estates)from R-3A (Owner Occupied Multi-Family Residential District)to PD (planned Development)."Ayes:Schmidt,Dutcher,Steele,Mook,Wilson,Hoifeldt,and Airhart. Nays:None.Motion carried. 228 Motion to Approve an Ordinance to amend Section 301.11,Single Family Residential District to include provisions and reqnirements for the nse of temporary buildings for residential lot and subdivision sales. On March 13,2007,Regency Homes requested the Planning and Zoning Commission to approve a site plan for a temporary sales office intended to be used to sell lots and homes within Regency developments within the City of Waukee.The proposed site was in Williams Pointe Plat 14 which is currently under construction.The current Zoning Ordinance does not include requirements or language directly related to this type of structure/use.Through research of some of the surrounding communities,staff has found a wide array of provisions and requirements for this type of use/building,There is little consistency other than the fact that the majority of all communities researched only allow for these types of temporary sales buildings within residential districts and do not extend into commercial and industrial districts,The proposed language indicates a temporary building for this specific use would be permitted following approval of a temporary site plan which would be reviewed by the Planning and Zoning Commission and approved by the City Council.Staff has proposed a time frame of two years from the date the site plan is approved that the temporary building must be removed.Additional provisions have been included regarding specific building and site design requirements as well as a provision for a cash or surety bond to pay for the cost of removal and restoration of the site by the City if the temporary building is not removed within 60 days after the temporary site plan expires.The specific ordinance revisions have been placed within section 301.11:R-I Single Family Residential District,however, would apply to the other residential districts as the allowable accessory uses for the remaining districts refer back to the allowed R-I Accessory Uses.The Commissioners discussed a potential change in the sign ordinance which is currently under review.The developer of a Planned Development would provide a provision either in the development agreement or in the covenants for this type of structure.Motion by Commissioner Airhart,seconded by Commissioner Mook to "Approve an Ordinance to amend Section 301.11,Single Family Residential District to include provisions and requirements for the use of temporary buildings for residential lot and subdivision sales."Ayes:Airhart,Mook,Dutcher,Steele,Wilson,and Hoifeldt.Nays:Schmidt.Motion carried. Motion to Approve an Ordinance to amend Section 301.037 Definitions;to include a definition for a temporary building.In coordination with the proposed amendment to Section 301.11 to allow for temporary buildings for residential sales uses,staff is recommending an amendment to Section 301.03 of the Zoning Ordinance to add a definition for a temporary building.Motion by Commissioner Schmidt,seconded by Commissioner Steele to "Approve an Ordinance to amend Section 301.03,Definitions to include a definition for a temporary building."Ayes:Schmidt,Steele,Airhart,Mook,Dutcher,Wilson,and Hoife1dt.Nays:None. Motion carried, New Business.Brag p~et~reminded the Commissioners of the Comprehensive Plan Advisory Meeting on Thursday April 26,2007 at 6:00 PM.
