MINUTES OF THE TUESDAY JUNE 13,2006 PLANNING AND ZONING COMMISSION
MEETING.
Chairman Hoifeldt called the June 13,2006 meeting of the Planning and Zoning Commission to order at
7:00 p.m.
Roll Call.Chairman Hoifeldt asked for a roll call and the following Commissioners were present:
Krantz,Dutcher,Hoifeldt,Steele,Wilson,Mook.Absent:Schmidt.Others in attendance:John
Gibson,Shannon Lynch,Dennis Dowell,Tim Royer,Council Member Don Bailey,and John Kursitis.
Agenda Approval.Motion by Commissioner Krantz,seconded by Commissioner Steele,to "Approve
the Agenda for June 13,2006 with the removal of agenda item #7."Ayes:Steele,Hoifeldt,Dutcher,
Krantz,Mook,Wilson.Nays:None.Motion carried.
Approval of May 23,2006 Meeting Minutes.Motion by Commissioner Mook,seconded by
Commissioner Wilson,to "Adopt the May 23,2006 Meeting Minutes."Ayes:Hoifeldt,Steele,Mook,
Krantz,Dutcher,Wilson.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum,
Approve the Preliminary Plat for Legacy Pointe at Waukee Plat 5.John Gibson explained that
Ewing Land Development is requesting approval for seven single family residential lots and a 3.15 acre
outlot in the Legacy Pointe Development.Mr.Gibson said City staff is recommending approval.
Motion by Commissioner Steele,seconded by Commissioner Wilson to "Approve the Preliminary Plat
for Legacy Pointe at Waukee Plat 5."Ayes:Hoifeldt,Steele,Mook,Dutcher,Krantz,Wilson.Nays:
None.Motion carried.
Motion to Approve the Rezoning and Changing Certain Property therein from A-I [Agricultural
District]to R-I [Single Family Residential District],and R-2 [One and Two Family Residential
District],and R-3A [Owner-Occupied Mnlti-Family Residential District],and R-4 [Row Dwelling
and Townhome Dwelling District]and C-IA [Neighborhood Commercial District]and a portion of
the C-IA [Neighborhood Commercial District]to PD-I [Planned Development Overlay District];
and amend the Official Zoning Map to show rezoning (a parcel to be known as Fox Creek
Estates).Mr.Gibson explained that the subject property is kuown as the Fox Farm and is located
approximately a half mile north of Hickman Road (Highway 6)and directly east of Warrior Lane.The
Comprehensive Plan for this area includes high density residential along the south portion of the
property,mixed density residential in the middle portion of the development and single family
residential in the north third of tile property.The proposed rezoning is generally in keeping with the
comprehensive plan.Mark Lee of Lee Engineers and Surveyors addressed the Commission.He said the
developer is aware of the sanitary sewer issue and has set funds aside in the budget.He said the
developer also understands they will be required to pave the streets in the development.Commissioner
Hoifeldt asked about the number of parking stalls and garages in the multi family dwelling section of the
development.Russ Ver Ploeg of Ver Ploeg Architects said they feel tile number of garages and parking
stalls was adequate partly because the amount of retail space had been reduced from the originally
proposed 102,000 square feet to 70,000 square feet and based on City Planner Brad Deets'
reconnnendation of a shared parking concept,Commissioner Hoifeldt asked for clarification about the
landscape buffer and open space requirements.Mr.Ver Ploeg said their concept meets the 30%open
space requirement.As for the 3 Oft buffer,they feel this is unusable space and would rather have more,
larger areas that can be used for recreation.Commissioner Hoifeldt asked Mr.Ver Ploeg about the
architectural requirements,specifically the stone,brick or glass recommended by City staff.Mr.Ver
Ploeg responded that if the requirements were for aesthetic reasons,they would request some flexibility.

Tara Davis of Davis Homes of Iowa addressed the Commission with concerns she had about the
proposed development.She requested more of a buffer between the single family residential homes in
the Gracewood development and the R-4 multi family section of the proposed development.Mr.Lee
responded by saying they were willing to put in a 40ft buffer instead of the required 30ft buffer.She
said she would like to see medium density use versus the high density being proposed.Ms.Davis said
the amount of retail space concerned her and was glad to hear that had been reduced.Councihnember
Don Bailey asked if there were any changes from what was seen before the Commission in May.Mr.
Lee explained that the density had decreased,the retail space was reduced,they were able to show more
detail in the condominium area and the building size had been reduced in the PD area from 80ft to 66ft.
Councilmember Bailey expressed his concerns that their proposed street plan deviated from the City's
major streets plan.He was also concerned about the sewer issues and with sandwiching multi family
and single family residential.Mr.Lee responded that they tried to follow the comprehensive plan as
close as possible per City staff requests and recommendations.Commissioner Steele said he felt there
were not enough garages.He also had concerns about the townhomes to the south,but that issue would
be eliminated if the developer put in the 40ft buffer as Mr.Lee indicated they would.He also added that
he would like the architectural requirements for building materials be limited to stone,brick or glass.
Mr.Gibson said Mr.Deets and the developer need to work out the garage issue.Commissioner Mook
said there have been cases in the past where developers have had to add garages because there were not
enough.He also expressed his belief that this project fits in with the major intersections project.The
Commission wanted the developer to be aware that they will restrict the architectural requirements to
stone,brick or glass.Motion by Commissioner Wilson,seconded by Commissioner Steele to "Approve
rezoning of approximately 150 acres of property from A-I Agricultural District to R-l Single Family
Residential,R-2 One and Two Family Residential,R-3A Owner Occupied Multi-Family Residential,R-
4 Rowhouse and Townhome Residential,C-IA Neighborhood Commercial and a portion of the C-IA
