Chairman Steele called the June 28,2005 meeting ofthe Planning and Zoning Commission to order at 7:03
p.m.
Roll Call.Chairman Steele asked for a roll call and the following Commissioners were present:Hoifeldt,
Schmidt,Wilson.Absent:Krantz,Mook.Council Representative:Mertz.
Agenda Approval.Motion by Commissioner Schmidt,seconded by Commissioner Hoifeldt,to "Approve
the Agenda for June 28,2005."Ayes:Hoifeldt,Schmidt,Wilson,Steele.Nays:None.Motion carried.
Approval of June 14,2005 Meeting Minutes.Motion by Commissioner Schmidt,seconded by
Commissioner Wilson,to "Adopt the June 14,2005 Meeting Minutes."Ayes:Hoifeldt,Schmidt,Wilson,
Steele.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum.
Approve the Preliminary Plat for Hunsberger Proprietor Plat 3.Greg Pierce of Nilles Associates
presented the preliminary plat.The plat will allow for the northern portion of the property to be sold to
develop Painted Woods Plats 2 and 3,and the southern portion to remain as Hunsberger property.Jo1m
Gibson stated that the parkland location within the plat had yet to be resolved;the City would like one large
parcel of parkland instead of several smaller parcels.Some discussion took place regarding access to the
Loots property,and how that property would be incorporated into the plat as a whole.Chad Weaver
explained that City staff has been in discussions with all affected parties,specifically regarding a possible
shared access off Ute Avenue that would serve both the Loots property and the commercial parcel to the
south.There is also the possibility of accesses to the rear ofthe Loots property from the south.Motion by
Commissioner Schmidt,seconded by Commissioner Wilson,to "Approve the Preliminary Plat for
Hunsberger Proprietor Plat 3,provided an agreement on parkland dedication is reached prior to City Council
consideration."After a brief discussion,Commissioner Schmidt amended his motion to "Approve the
Preliminary Plat for Hunsberger Proprietor Plat 3,provided an agreement on parkland dedication is reached
prior to City Council consideration of the final plat."Commissioner Wilson amended his second.Ayes:
Hoifeldt,Schmidt,Wilson,Steele.Nays:None.Motion carried.
Approve the Comprehensive Plan Amendment of Painted Woods Plats 2 and 3.Greg Pierce of Nilles
Associates presented the Comprehensive Plan amendment request.The developer requests an amendment
from Urban Reserve and Commercial to Single Family Urban Residential to allow for single family home
development.Motion by Commissioner Schmidt,seconded by Commissioner Hoifeldt,to "Approve the
Comprehensive Plan Amendment of Painted Woods Plats 2 and 3."Ayes:Hoifeldt,Schmidt,Wilson,
Steele.Nays:None.Motion carried.
Approve the Rezoning of Painted Woods Plats 2 and 3 from A-I [Agricultural District]to R-l [Single
Family Residential District].Greg Pierce of Nilles Associates presented the rezoning request.He
explained that a preliminary plat for Painted Woods Plat 2 has already been submitted to the City for review,
and that construction on that plat was planned for fall 2005.The developer plans to mirror the look of
Painted Woods Plat 1,as well as keeping as many existing trees as possible.All planned single family lots
will have a minimum 100'frontage,which will far exceed the minimum bulk regulations for R -1 zoning.
Motion by Commissioner Schmidt,seconded by Commissioner Hoifeldt,to "Approve the Rezoning of
Painted Woods Plats 2 and 3 from A-I [Agricultural District]to R-I [Single Family Residential District],
provided all Plat 2 public improvements are completed within 3 years of rezoning,or the property will revert
to A-I zoning."Ayes:Hoifeldt,Schmidt,Wilson,Steele.Nays:None.Motion carried.
liUprove the Site Plan Revisions for Waukee Middle School Concession Stand/Batting Facility.Eric
Rose of the Waukee Community School District was in attendance.Commissioner Hoifeldt explained that
the sub-committee recommended that a five-year moratorium be imposed,by which time the concession r 1
stand must be brought into compliance with the approved site plan.Mr.Rose stated the school district's I
support of the recommendation,and that the revised site plan for the concession stand would be submitted in J
conjunction with plans for the Waukee Middle School remodel.Commissioner Hoifeldt also clarified that
there was no conflict of interest between his job and the concession stand proj ect.Motion by Commissioner
Hoifeldt,seconded by Commissioner Schmidt,to "Approve the Site Plan Revisions for Waukee Middle
School Concession StandlBatting Facility."Ayes:Hoifeldt,Schmidt,Wilson,Steele.Nays:None.Motion
carried.
Discuss tile City of Overland Park,KS Ordinances.The Commission reviewed the site planning and land
disturbance sections of the "Commercial Design Guidelines and Standards."There was some discussion
regarding perennial waterways and erosion control.Mark Arentsen and Dennis Dowell explained that a
storm water pollution ordinance will be adopted by the City this fall in order to address the issue.
