MINUTES OF THE TUESDAY,JULY 27,2004 PLANNlNG AND ZONING COMMISSION
MEETING.
Chairman Steele called the July 27,2004 meeting of the Planning &Zoning Commission to order at
7:05 p.m.
Roll Can.Chairman Steele asked for a roll call and the following Commissioners were present
Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White.Absent:None.Council Representative:Mertz.
Agenda Approval.Chairman Steele asked that the Open Forum listed as agenda item #14 be moved
to #6,and each subsequent item be renumbered thereafter.Motion by Commissioner Schmidt,
seconded by Commissioner White,to "Approve the Agenda for July 27,2004 with agenda item #14
moved to #6 and each subsequent item renumbered thereafter."Ayes:Hoifeldt,Korpanty,Krantz,
Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Approval of May 27,2004 Special Joint Meeting Minutes.Chairman Steele asked if there were any
changes to the May 27,2004 minutes.None.Motion by Commissioner Willits,seconded by
Commissioner Schmidt,to "Adopt the May 27,2004 Special Joint Meeting Minutes."Ayes:Hoifeldt,
Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Approval of June 8,2004 Meeting Minutes.Chairman Steele asked if there were any changes to the
June 8,2004 minutes.None.Motion by Commissioner Hoifeldt,seconded by Commissioner White,
to "Adopt the June 8,2004 Meeting Minutes."Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,Willits,
White,Steele.Nays:None.Motion carried.
Approval of June 28,2004 Special Joint Meeting Minutes.Chairman Steele asked if there were any
changes to the June 28,2004 minutes.None.Motion by Commissioner Hoifeldt,seconded by
Commissioner Korpanty,to "Adopt the June 28,2004 Special Joint Meeting Minutes."Ayes:
Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum.
Discuss the Annexation of Brummett Acres.John Brummett addressed the Commission.He
explained his desire to subdivide his property without being annexed by the City.He wishes to annex
whenever Hunter Hollow is annexed.Mark Arentsen explained the City's position that properties
contiguous with City limits should be required to annex in order to subdivide.Commissioner Schmidt
expressed concern that ifMr.Brummett sells part of his property after subdividing,that anyarmexation
agreement may not apply to the new owner.Mr.Arentsen also stated that there may be difficulties at a
later date if Hunter Hollow is involuntarily annexed.Chad Weaver informed the Commission that the
City has received complaints in the past from property owners subdividing small parcels.The
complaints stem from the costs involved with the City's subdivision procedures,such as engineering
fees and City review of plans.Mr.Weaver asked that the Commission consider possible alternatives
for the subdivision of small parcels or reaffirm their desire to continue with the current process.
Chairman Steele and Commissioners Korpanty,Schmidt and White recommended to the City Council
that the Brummett property be armexed in 5 years,or when the Hunter Hollow subdivision is armexed,
whichever happens first.Commissioners Hoifeldt,Krantz,and Willits recommended that the
annexation occur in 2.5 years,or when Hunter Hollow is annexed,whichever happens first,Mr.

Brummett agreed to wait for the City Council's decision on his possible annexation prior to moving
forward with the platting process.
Approve the Ordinance Change §304.5(M)(7)-Arterial Corridor Overlay Ordinance.The
Commission discussed how many gas stations would be possible within the limitations of one every %
mile.Commissioners Korpanty and Hoifeldt questioned whether the distance would be measured
along the lineal frontage of the corridor streets,or as within a radial distance from each business.Chad
Weaver agreed to clarify the language in the ordinance regarding the measurement.Commissioner
Schmidt stated his desire to remove the use of residential-style vinyl or metal siding from the
ordinance.Motion by Commissioner Hoifeldt,seconded by Commissioner Schmidt,to "Approve the
Ordinance Change §304.5(M)(7)-Arterial Corridor Overlay Ordinance,with the clarification of the
measurement of the distance between convenience stores and gas stations,and with the prohibition of
residential-style vinyl or metal siding as a trim material."Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,
Willits,White,Steele.Nays:None.Motion carried.
Approve the Tobacco and Alcohol Sales Ordinance.Mark Arentsen explained that this ordinance
was requested by the Waukee School District to limit the sales of tobacco and alcohol within the
proximity of a school.Conunissioner Schmidt asked for clearer language to differentiate between
alcohol sales and on-site consumption of alcohol.The Commission asked that a representative of the
school district be present at the next Planning &Zoning Conunission meeting to explain the school's
position on the subject.Motion by Conunissioner Krantz,seconded by Commissioner Willits,to
"Table the Tobacco and Alcohol Sales Ordinance until a representative of the school district is
present."Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion
carried.
Approve the Alice's Road Corridor Plan.Chad Weaver explained that the plan was still in draft
form,and asked that approval be postponed until the next Planning &Zoning Commission meeting.
He also stated that any suggestions to help clarify the plan would be welcome.Motion by
Commissioner Willits,seconded by Commissioner White,to 'Table the Alice's Road Corridor Plan
until the August 10,2004 Planning &Zoning Commission meeting."Ayes:Hoifeldt,Korpanty,
Krantz,Schmidt,Willits,White,Steele.Nays:None.Motion carried.
Approve the Major Streets Plan.Jolm Kursitis of Veenstra and Kinrrn presented the Major Streets
Plan.The plan shows major and minor collectors,and eliminates some non-functional loops from the
Comprehensive Plan.The plan also contains stricter right-of-way provisions than in the current
subdivision ordinance,as well as provisions for the responsibility of developers to improve and pave
any adjoining existing gravel streets.The street plan has been coordinated with the major street plans
of the cities of West Des Moines and Clive.Motion by Commissioner Schmidt,seconded by
Commissioner Krantz,to "Postpone the Approval of the Major Streets Plan until the August 10,2004
Planning &Zoning Commission meeting."Ayes:Hoifeldt,Korpanty,Krantz,Schmidt,Willits,White,
Steele.Nays:None.Motion carried.

Discuss the Berm Requirements in the Site Plan Ordinance.Conunissioner Schmidt asked that the
ordinance be clarified to ask specifically for 3-foot opaque barriers,and discourage the substitution of
plantings in lieu of any berming or barriers.The Commission agreed to discuss the berm requirements \1
at the August 10,2004 Planning &Zoning Commission meeting.J

Discuss the Residential Zoning Districts.Commissioner Schmidt asked if developers should be
required to zone a certain percentage of residential development as R-l to eliminate excessive R-2
zoning.He also suggested that design standards in R-3 and R-4 zoning be reconsidered,perhaps based
on the size of a structure and not merely the zoning district.The Commission agreed to discuss the
residential zoning districts at the August 10,2004 Planning &Zoning Commission meeting.
Discuss the Conditional Uses.Commissioner Schmidt questioned the legality of conditional uses in
zoning districts.Chad Weaver explained that he was gathering more information from other
communities on conditional use permits,He also stated that one ofthe problems with conditional use
permits is the arbitrary and subj ective nature with which such permits could be approved.The
Commission agreed to discuss conditional uses at the August 10,2004 Planning &Zoning
Commission meeting.
