MINUTES OF THE TlJESDAY AUGUST 8,2006 PLANNING AND ZONING COWAISSION
MEETING.
Chairman Hoifeldt called the August 8,2006 meeting ofthe Planning and Zoning Commission to order
at 7:00p.m.
Roll Call.Chairman Hoifeldt asked for a roll call and the following Commissioners were present:
Hoifeldt,Wilson,Schmidt,Mook,Krantz.Absent:Dutcher,Steele.Others in attendance:Shannon
Lynch,Brad Deets,Dennis Dowell and John Kursitis,Council Member Bailey arrived at 7:20 pm.
Agenda Approval.Motion by Commissioner Krantz,seconded by Commissioner Wilson,to "Amend
the Agenda for August 8,2006 by moving Item #5 after Item #11 or until Council Member Bailey
arrives."Ayes:Hoifeldt,Schmidt,Mook,Wilson,Krantz.Nays:None.Motion carried.
Approval of July 11,2006 Regular Meeting Minutes.Motion by Commissioner Schmidt,seconded
by Commissioner Krantz,to "Adopt the July II,2006 Regular Meeting Minutes."Ayes:Hoifeldt,
Mook,Schmidt,Krantz,Wilson.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum,
Motion to Approve the Preliminary Plat for Daybreak.City Planner Brad Deets explained that the
subject property is located north of Ashworth Road and west ofR-22 (Ute Avenue).The property is
currently located within Dallas County but is expected to be annexed into the City of Waukee by the
end of this year.City staff has begun the notification and meeting process for annexation of the

classification of R-3 Residential.The developer is continuing the preliminary plat and construction
drawing approval process through the County due to the lag in the annexation for this particular area.
Upon annexation of the property into the City,the property will need to be rezoned to a combination of
R-I Single Family Residential,R-2 One and Two Family Residential and R-4 Row Dwelling and
Townhome Dwelling District.The applicant has designed the preliminary plat and construction
drawings to conform to the City of Waukee Standard Specifications.The preliminary plat shows the
development ot 186 single family lots and two townhome lots.The townhome lots are 10 acres and
8.28 acres respectively.In addition to the single family and townhome development,two parcels
totaling 8.2 acres and shown as Outlot A and Outlot B will be dedicated to the City for a park.The
main access to the development will be provided off of Ashworth Road.A secondary access point has
been shown north of Ashworth Road with a direct connection out to R-22.In working with previous
City staff,the applicant determined this location and obtained an easement from the property owner.
Since that time both current staff and Veenstra and Kimm have reviewed the proposed access out to R-
22.Based upon review by Veenstra and Kinnn,there is some concern regarding the vertical visibility
ofthe access point looking north.The alignment to the south meets minimum AASHTO reqnirements.
Jolm Kursitis of Veenstra and Kinnn explained there are 3 different alternatives that would meet
horizontal and vertical requirements and they would prefer one of these three options.Erin Ollendike
of Civil Desigu Advantage addressed the Commission.Ms.Ollendike suggested that warning lights
and signage be used at the proposed connection out to R-22.Discussion followed regarding the
proposed access.
Motion by Commissioner Sclnnidt,seconded by Commissioner Krantz to "Approve the Preliminary
Plat for Daybreak Contingent upon all Outstanding Staff Comments and a recommendation that the
middle access point as provided by Veenstra and Kimm be utilized that meets minimum AASHTO

requirements for both vertical and horizontal site distance.Ayes:Hoifeldt,Mook,Krantz,Schmidt,.
Wilson.Nays:None.Motion carried.
Motion to Approve the Preliminary Plat for Walnut Cove.Mr.Deets explained that the subject
property is a vacant lot located within an established residential neighborhood.The property is zoned
R-2 [One and Two Family Residential District]allowing for both single family homes and bi-attached
homes,The applicant is proposing to construct 12 hi-attached units on six lots.At this time,the
applicant is requesting approval of a preliminary plat showing the lot layout as well as the public
utilities and street locations.The preliminary plat shows the construction of six lots off of a cul de sac.
The six proposed lots meet the minimum requirements of the R-2 zoning district.The applicant has
stated that the units would be ranches and approximately 1,300 square feet in size.In addition to the
six lots,a small outlot is proposed which would be owned and maintained by a homeowner's
association for the development.The property includes a large number of existing mature trees.In
order to develop the property,a number of existing trees will need to be removed.A survey has been
prepared of the existing trees on the property and staff has asked that as many existing trees as possible
be saved.Jesse Duffwith Cooper Crawford has said the developer will save as many trees as possible
and he explained some of the storm sewer issues.Council Member Bailey expressed concern that
putting in roads,houses,etc would create more water and faster runoff.Mr.Duff said with what they
are proposing,the additional runoff will not be a problem.Kerry Eubanks,850 Cedar Street,has
requested more definitive drawings and a timeline from the developer since the proposed easement
would run along the back of his property.James Stewart,840 Cedar Street,addressed the Commission
regarding any additional easements that would be on his property.Mr.Deets explained that anything
that needed to be done would be within the existing easement on the property.John Bruecken,490 9'h
Street,said he would like some input on what will go light next to the property he has lived on for 20
years.Mr.Bruecken said his concern is the possibility of a house being built 7 feet away from his
property.Dennis Petersen,860 Cedar Street,addressed the Commission with his concern that his
property could possibly lose value.He also stated that current drainage on the lot is good and he is
concerned that the proposed changes will adversely affect the drainage.Sue Seidenfeld,840 Locust
Street,said she has lived at her current address for eight years.They have not had any drainage
problems and she would like assurances from the developer that these issues will not arise as a result of
the changes they are proposing.Ms.Seidenfeld also expressed her concern about the number of
driveways that will be coming out onto Locust Street and snow removal issues in the winter.Mr.
Deets said the City is satisfied mat Locust Street will be able to handle the number of driveways
proposed.Commissioner Mook said it seems as if there are too many outstanding issues for the
Commission to approve the plat at this time.Commissioner Schmidt agreed adding he would prefer to
table me issue until all agreements between property owners and the developer are in place.
Commissioner Mook said everything else with the plat seems acceptable except for the easement
issues.Chairman Hoifeldt suggested the developer update their drawings and get the easement issues
worked out with the neighbors.Motion by Commissioner Schmidt,seconded by Commissioner
Wilson to "Table the Consideration of the Preliminary Plat for Walnut Cove until August 22,2006."
Ayes:Hoifeldt,Mook,Schmidt,Krantz,Wilson.Nays:None.Motion carried.
Motion to Approve the Site Plan Extension for Legacy Pointe Village Center.Mr.Deets
explained that me site plan for the 18,000 square foot two-story mixed use bnilding at the comer of SE
Legacy Pointe Boulevard and SE Golden Harvest Drive was approved by the City Council on
September 19,2006.The site plan ordinance states that site plans are valid for one year after approval
with the ability to receive a one year extension on me site plan if requested.The applicant,Urban
Development has requested that the Planning and Zoning Commission and City Council consider a
one-year extension for the approved site plan.The applicant has stated the reason the project has not

been constructed is because of access issues at the comer of Hickman Road and SE Legacy Pointe
Boulevard along with escalating construction costs.The previously approved site plan meets the
requirements of the Amended Legacy Pointe Planned Development and City Staff would recommend 1
approval of the requested one year extension of the site plan.Motion by Commissioner Mook,
seconded by Commissioner Schmidt to "Approve the Site Plan Extension for Legacy Pointe Village ,
Center."Ayes:Hoifeldt,Mook,Krantz,Schmidt,Wilson.Nays:None.Motion carried.
Motion to Approve the Request for Proposals for Comprehensive Plan Update.Mr.Deets
explained that the existing Comprehensive Plan was completed in 2001.Since that time,the
substantial growth that the City has seen occur has made a number of things within the current
Comprehensive Plan out of date,particularly the proposed future limits of development and land use.
Staff has been preparing a request for proposals that will be sent out to firms to begin the process of
updating the existing plan.Mr.Deets also expressed his desire for a committee to be put together to
review proposals.Council Member Bailey said he is concerned about some firms trying to cut back on
the amount of public meetings.Motion by Commissioner Krantz,seconded by Commissioner Wilson
to "Approve the Request for Proposals for Comprehensive Plan Update."Ayes:Hoifeldt,Mook,
Krantz,Schmidt,Wilson.Nays:None.Motion carried.
Discuss the Hickmau West Industrial Park -Overlay District Requirements.Mr.Deets explained
that this site at 1115 Westbrooke Drive falls within the Corridor Overlay District and has to meet those
additional requirements.The applicant is requesting this discussion as they would like relief from
those additional requirements on this particular site.Commissioner Schmidt referred to the Reickes
building located across the street and stated his opinion that any new buildings within the development
at a minimum needed to meet those standards as it related to architectural relief and building materials.
Commissioner Krantz said he believes they should meet the standards that have been set as much as
possible.Council Member Bailey asked if the proposed building would meet the additional
requirements.Mr.Deets said in the front they would,but the sides and back do not meet the 70%
masonry requirements.Kevin Sabus of Point Builders asked if consideration would be given for
expansion.Commissioner Krantz said the problem with that is there's no guarantee an expansion will
occur.
Discuss Existing "Tree Preservation.Discussion tookplace regarding existing tree preservation.The ..
Commission agreed that the developers should be required to do some tree preservation but would
prefer it be done site by site and recommended that staff look at incentives for developers to retain
existing large trees.
Discuss CI-B Open Space Requirements.Mr.Deets explained that the current provisions for the C-
IB Large Scale Commercial District require a minimum of 30%open space based upon the gross land
area ofthe zoned property.Provisions for open space within the C-l Community and Highway
Service Commercial District and C-IA Neighborhood Commercial District are 20%and within the C-3
Planned Commercial Development District and C-4 Office Park Commercial District,the provisions
for open space are 25%.He said Waukee requires more open space than other communities and
wondered where the 30%number came from.Discussion followed.It was the general consensus of
the Commission that they would not be opposed to looking at a different percentage if it made since.
Staff stated they would do further research on this and may be back in the future requesting a change to
the Ordinance.
