MINUTES OF THR TUESDAY,AUGUST 23,2005 PLANNING A-ND ZONING COMMISSION
MEETING.
Vice Chairman Hoifeldt called the August 23,2005 meeting of the Planning and Zoning Commission to
order at 7:00 p.m.1
Roll Call.Vice Chairman Hoifeldt asked for a roll call and the following Commissioners were present:
Dutcher,Krantz,Mook,Schmidt,Wilson.Absent:Steele.Council Representative:Mertz.
Agenda Approval.Motion by Commissioner Dutcher,seconded by Commissioner Wilson,to "Approve
the Agenda for August 23,2005."Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson.Nays:
None.Motion carried.
Approval of August 9,2005 Meeting Minutes.Motion by Commissioner Schmidt,seconded by
Commissioner Krantz,to "Adopt the August 9,2005 Meeting Minutes."Ayes:Dutcher,Hoifeldt,Krantz,
Mook,Sclnnidt,Wilson.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum.
Approve the Preliminary Plat for Painted Woods Plats 2 and 3.John Gibson introduced the
preliminary plat.The remaining issues include parkland dedication and sanitary sewer service to the site.
The developer has agreed to move the requested parkland from this plat to the future Daybreak
subdivision,which is also owned by this developer.The Park Board has approved the agreement,but it
must be in written form prior to City Council consideration.Mik Briedis of V &K spoke regarding the
sanitary sewer service,explaining that an agreement was already in place amongst four of the larger
property owners in the area (Hunsberger,Gabus,Scaglione and West Central Auto Auction)regarding the
need for sanitary sewer service in the area.He also passed out a memo dated August 4,2005 outlining the
terms of the agreement.Mr.Briedis also explained that a regional pump station would be constructed,
and then eventually abandoned once the WRA takes over administration of the sewer lines.If certificates
of occupancy for Painted Woods Plats 2 and 3 are issued prior to the completion of the regional pump
station,the developer has agreed to pump and haul any waste in a timely manner until the pump station is
fully functional.At this point,Greg Pierce of Nilles Associates addressed the Connnission and stated that
the developer agreed to all such requirements.Motion by Connnissioner Schmidt,seconded by
Commissioner Krantz,to "Approve the Preliminary Plat for Painted Woods Plats 2 and 3,provided I)a
written agreement regarding parkland dedication be in place prior to City Council consideration;2)the
sanitary sewer agreement in place amongst the Hunsberger,Gabus,Scaglione and West Central Auto
Auction interests is put into effect;and 3)the Painted Woods developer agrees to pump and haul any
waste in a timely manner until the regional pump station is completed and operational."Ayes:Dutcher,
Hoifeldt,Krantz,Mook,Schmidt,Wilson.Nays:None.Motion carried.
Approve the Preliminary Plat for Legacy Pointe Plat 4.John Gibson introduced the preliminary plat,
stating that all comments have been addressed.Josh Cowman of Ewing Land Development explained
that the lots would be developed as duplex townhomes,not single family homes.Motion by
Commissioner Mook,seconded by Commissioner Dutcher,to "Approve the Preliminary Plat for Legacy
Pointe Plat 4."Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson.Nays:None.Motion carried.IApprovetheRezoningofLegacyPointePlat1,Lots 3-5,from C-l [Community and Highway
Service Commercial District]and PD-l [Planned Development Overlay District]to C-l
[Community and Highway Service Commercial District]and PD-l [Planned Development Overlay
District](pD revision).Chad Weaver introduced the rezoning application,explaining that the
Commission had already approved the proposed changes in ordinance form,but that the City attorney

requested that the changes be made through the rezoning process.Mr.Weaver also explained that the
trash enclosures for the southeast building had been moved or reoriented to the satisfaction of City staff,
and that the proposed northwest building had been shifted in order to allow better visibility of the Iowash
building from SE Blackthome Drive.As a result of this shift,the building setbacks in the PD would need
to be revised to allow for the northwest building to be constructed within the side yard setback.Scott
Stricker,vice president of Urban Development Group,then addressed the Commission,stating that the
developer had obtained the signatures ofthe owners of 50%of the surrounding properties.He explained
r that they were still working to get signatures from representatives of Earl May,and that they had been
unable to contact Carole Crate of Clive.Mr.Stricker also asked that the developer be allowed to work
with City staff on the location of a trash enclosure for the proposed northeast building;Vice Chairman
Hoifeldt explained that such a detail would be discussed at site plan submittal for that particular building.
Motion by Commissioner Krantz,seconded by Commissioner Wilson,to "Approve the Rezoning of
Legacy Pointe Plat 1,Lots 3-5,from C-l [Community and Highway Service Commercial District]and
PD-l [Planned Development Overlay District]to C-l [Community and Highway Service Commercial
District]and PD-l [Planned Development Overlay District](PD revision),provided the proposed
northwest building would be allowed to encroach into the side yard setback."Ayes:Dutcher,Hoifeldt,
Krantz,Mook,Schmidt,Wilson.Nays:None.Motion carried.
Approve the Site Plan for Shottenkirk Chevrolet Addition.No one appeared before the Commission
to address the site plan.The Commission decided to move this agenda item to the end of the meeting.

Approve the Preliminary Plat for Glynn Village Plat 1 (Revised).John Gibson introduced the
preliminary plat,explaining that Mr.Phil Broderick no longer had any objections to the alley-loaded
single family lots abutting his property to the east,and that the developer would work with the City to
relocated the alley accesses for the townhomes and single family homes.The developer will be building
2-StOlYtownhomes,not 3-story townhomes,and there will be additional benning along L.A.Grant Pkwy.,
University Ave.,and the SE Allye St.alleyways.Commissioner Schmidt stated that the Brighton Park
Homeowners Association no longer objected to the rezoning,provided 2-story townhomes be constructed
instead of 3-story townhomes.Joe Petryzinski of Hubbell Homes then addressed the Commission,along
with Doug Saltsgaver of Engineering Resource Group (ERG).Motion by Commissioner Krantz,
seconded by Commissioner Dutcher,to "Approve the Preliminary Plat for Glynn Village Plat 1
(Revised)."Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson.Nays:None.Motion carried.
Approve the Site Plan for Shottenkirk Chevrolet Addition.No one appeared before the Commission
to address the site plan.The Commission agreed to postpone consideration of the site plan until the next
regular meeting.
New Business.None.
Adjournment.Motion by Commissioner Schmidt,seconded by Commissioner Dutcher,to adjoum at
