Chairman Hoifeldt called the September 11,2007 meeting of the Planning and Zoning Commission to order at 1, 7:00 p.m. l Roll Call.Chairman Hoifeldt asked for a roll call and the following Commissioners were present:Hoifeldt, Dutcher,Steele,Mook,and Schmidt,Wilson,and Airhart.Absent:None.Others in attendance:Beth Richardson,Brad Deets,Ben Landhauser,Jeff Kooistra,John Kursitis,and Councilmember Don Bailey,Jr. Agenda Approval.Motion by Commissioner Steele,seconded by Commissioner Mook,to "Approve the Agenda for September 11,2007."Ayes:Steele,Mook,Airhart,Schmidt,Dutcher,Wilson,and Hoifeldt.Nays:None. Motion carried. Approval of July 31,2007 Regular Meeting Minutes.Motion by Commissioner Schmidt,seconded by Commissioner Mook,to "Adopt the July 31,2007 Regular Meeting Minutes."Ayes:Schmidt,Mook,Airhart, Dutcher,Wilson,Steele,and Hoifeldt.Nays:None.Motion carried. Open Forum.No one appeared to address the Commission during the Open Forum. Motion to Approve the Rezoning for a parcel of land from R-4 Row Dwelling and Townhome Dwelling District and PD-l Planned Development District to R-3 Rental Multi-Family Residential District and PD-l Planned Development District (Williams Ponte Plat 12).Director of Planning,Brad Deets,briefly explained the applicants request for rezoning of approximately 18.7 acres of property from multi family residential to commercial.Mark Traumbauer,representing Regency Land .Company,explained the project would be higher end/entry level apartments with rent averaging $300 more per month than similar apartment settings in the Waukee area.Director of Planning,Brad Deets,went on to explain that from a land use perspective,the request 1 seems to be inconsistent with good planning practices of transitioning uses from higher intensity such as J' commercial and industrial zones to lower intensity uses such as single family.The typical hierarchy would be to place apartments or condominiums next to commercial or industrial and then townhomes between apartments/condominiums and single family homes.In this case,the proposed apartment development would be directly in the middle of a single family development and townhome developments.The Commissioners expressed concern that the developer would request a zoning change on the lot to the west which is also currently zoned for townhomes to build lower end apartment complex.Regency was unable to identify what the plan for the lot would be in the future althought1:ley would like to have it remain as it is currently zoned.Theproposed site contains a large buffer area to the east ofthe project along the single family residential area and the developer has proposed providing additional landscaping/screening along the south side of the project.Leora Thomas of 583 SE Williams Court,neighbor to the south of the project,spoke against the project preferring townhomes as designated in the development area rather than apartments.Mark Traumbauer stated that Regency would be willing to shift the 3 story apartments on the south end of the development north and change them to 2-stOlY apartment buildings to provide a more palatable view for the neighbors to the south.Motion by Commissioner Mook,seconded by Commissioner Dutcher to "Postpone the request,send it back to the developer and staff for modifications,and review the revisions at a later meeting."Ayes:Mook,Dutcher,Schmidt,Steele,Hoifeldt, Wilson,and Airhart.Nays:None.Motion carried. Motion to Approve the Rezoning for a parcel of land from R-3/R-3A Rental or Owner Occupied Multi- Family Residential District and PD-l Planned Development District to C-l Community and Highway Service Commercial District and PD-l Planned Development District (Williams Pointe Plat 13).Director of Planning,Brad Deets,explained the applicants request for approval of rezoning approximately 14.2 acres of • property from multi family residential to commercial.The property is a part of the Williams Pointe North I Planned Development and requires an amendment to the Planned Development.Motion by Commissioner J Schmidt,seconded by Commissioner Steele to "Approve the Rezoning for a parcel ofland from R-3/R-3A Rental or Owner-Occupied Multi-Family Residential District and PD-l Planned development District to C-l Community and Highway Service Commercial District and PD-l Planned Development District (Williams Pointe Plat 13)." Ayes:Schmidt,Steele,Mook,Airhart,Hoifeldt,Wilson,and Dutcher.Nays:None.Motion carried. 237 Motion to approve the Final Plat for Parkview Crossing Plat 8.Director of Planning,Brad Deets,explained the applicants request for approval of a final plat for the development of 16 townhome units.The final plat also indicates one outlot for future development.The plat is generally located east of LA Grant Parkway and south of SE University Avenue adjacent to Parkview Crossing Plats 6 &7 containing 10.38 acres.Motion by Commissioner Mook,seconded by Commissioner Schmidt to "Approve the final plat for Parkview Crossing Plat 8."Ayes:Wilson,Airhart,Mook,Dutcher,Schmidt,Hoifeldt,and Steele.Nays:None.Motion carried. Motion to approve the Site Plan for Parkvlew Crossing Plat 8.Director of Planning,Brad Deets,explained the applicants request for approval of a site plan for the development of 16 townhome units.The site plan also indicates one outlot for future development.The development is generally located east of LA Grant Parkway and south of SE University Avenue adjacent to Parkview Crossing Plats 6 &7 containing 10.38 acres.The project will contain 61 total units with the units around the pond area containing full basements or day lighted windows and the remaining townhome units will be slab on grade.Motion by Commissioner Schmidt,seconded by Commissioner Wilson to "Approve the site plan for Parkview Crossing Plat 8 Townhomes subject to the resolution of item #16 on the staff letter dated September 6,2007 which states "Staff continues to recommend intakes be provided on the private street to intercept storm water flow from the development.Waukee Standard Specifications provides that any storm water coming from a public street must be picked up by intakes prior to reaching an intersection.We are requesting the intakes in order to meet this requirement".Ayes:Schmidt, Wilson,Mook,Airhart,Dutcher,Steele,and Hoifeldt. Discussion -Legacy Pointe Planned Development/Village Market at Legacy Pointe Development.Director of Planning,Brad Deets,explained that Tim Urban,the property owner/developer of the Village Center Project, located adjacent to Earl May and the Iowash Carwash,has requested his proposal to develop Lot 3 of the Legacy Ponte Planned Development to accommodate a Jiffy Lube be brought before the Commission in order to receive some guidance as whether this proj ect would be an acceptable use of Lot 3.In order to proceed with this proposal,the applicant would need to request an amendment be made to the Legacy Ponte Planned Development Agreement.The Commission discussed the removal of the sole use requirement and reviewing all three lots together with and without the car wash.If Jiffy Lube was to meet all of the overlay district requirements,then the Commission would not be opposed to the project.The C-l uses would need to be clarified as to what they will and will not allow in the development. New Business.Commissioner Schmidt expressed concerned that the Regency Welcome Center was no longer going to be built and the City had changed the zoning ordinance to accommodate for the request. Brad Deets advised the Commission that there is a Comp Plan Advisory meeting on Thursday evening where they will review the Comp Plan.After the Comp Plan Advisory Committee has reviewed the Comp Plan,the Comp Plan will be sent to the Planning and Zoning Commissioners,City Council,and available for public review. Brad sent out an e-mail inviting the Planning &Zoning Commission to attend a remote site workshop on LEED design through the American Planning Association. Adjournment.Motion by Commissioner Steele,second by Commissioner Schmidt,to adjourn at 7:50 p.m.Ayes:Steele,Schmidt,Dutcher,Mook,Hoifeldt,Airhart,and Wilson.Nays:None.Motion carried.
