MINUTES OF THE TUESDAY SEPTEMBER 23,2003 PLANNING AND ZONING COMMISSION
MEETING.
Chairman Steele called the September 23,2003 meeting of the Planning &Zoning Commission to
order at 7:02 p.m.)
Roll Call.Chairman Steele asked for a roll call and the following Commissioners were present:
Hoifeldt,Schmidt,White,Steele.Absent:Korpanty,Krantz,Willits.Council Representative:
Stanton.(Commissioner Korpanty arrived at 7:18 p.m.)
Agenda Approval.Chairman Steele asked to add an Open Forum as agenda item #4,and change the
numbering for all agenda items thereafter.Motion by Commissioner Schmidt,seconded by
Commissioner White,to "Approve the Agenda for September 23,2003 with the addition of an Open
FOlUm as item #4 and the renumbering of all agenda items thereafter."Ayes:Hoifeldt,Schmidt,
White,Steele.Nays:None.Motion carried.
Approval of September 9,2003 Meeting Minutes.Chairman Steele asked if there were any changes
to the September 9,2003 minutes.None.Motion by Commissioner Schmidt,seconded by
Commissioner White,to "Adopt the September 9,2003 Meeting Minutes."Ayes:Hoifeldt,Schmidt,
White,Steele.Nays:None.Motion carried.
Open Forum.Bill Inman,co-owner of Liberty Park Mall,addressed the Commission.He explained
that he had been in the process of adding vinyl siding to the rear elevation of the mall when he was
stopped by the City and told that vinyl siding is not approved for buildings in a commercial district.]
The vinyl siding was intended to cover the cracking of the concrete block along the rear elevation.Mr.
hunan read aloud from a letter he received from the Liberty Park Townhome Association indicating
their approval of the use of vinyl siding.Chad Weaver explained that Mr.hunan's request could
conceivable go before City Council and that the Commission,as an advisory board,could render their
opinions on the matter.However,he and Dennis Dowell were of the opinion that the matter needed to
go before the Board of Adjustments.Becky Schuett read aloud from Waukee Municipal Code
§301.29(C)to clarify the interpretation that the matter go before the Board of Adjustments.City
Attomey Paul Huscher will be consulted as to how Mr.hunan should proceed with his appeal.
Commissioners Hoifeldt,White and Steele stated that they did not have a problem with vinyl siding in
this instance,but that the matter should go before the Board of Adjustments.Commissioner Schmidt
.stated.that.as long as-the-Board-of-Adjustments or-City-Council appro¥es-the-vinyLsiding,-he-diduQt------
have an issue with its use in this instance.Commissioner Schmidt also explained his opinion that it
could be difficult to enforce the City's ordinances if the Commission begins approving variances.
Commissioner Korpanty abstained from giving his opinion on the matter,as he arrived late.
Approve the Final Plat for the Replat of Park view Crossing Plat 2.Aaron Putnam of Engineering
Design Services (EDS)presented the Final Plat for the Replat of Park view Crossing Plat 2 on behalf of
Jerry's Homes.Also in attendance was Rick Ross.The replat would combine Outlot Z,which is a
storm sewer and surface water flowage easement,with single family lots 23 through 28.Owners of
those lots would then have the responsibility of maintaining the easement in accordance with City
ordinances.Motion by Commissioner Hoifeldt,seconded by Commissioner Schmidt,to "Approve the "
Final Plat for the Replat of Park view Crossing Plat 2."Ayes:Hoifeldt,Korpanty,Schmidt,White,j
Steele.Nays:None.Motion carried.

Approve the Rezoning for Williams Pointe Condominiums from R-3 (Mnlti-Family Residential)
to PD-l (Planned Development Overlay District).Brad Cooper of Cooper Crawford &Associates
presented the Rezoning for Williams Pointe Condominiums from R-3 (Multi-Family Residential)to
PD-l (Planned Development Overlay District).Also in attendance was Mike Simonson of Simonson
&Associates,the architects for the project.The PD would allow more units per building than is
currently allowed in R-3 zoning.Also,to accommodate the attached garages planned for tile
development,the PD would allow a 26-foot separation between buildings instead of the required 40
feet.Mr.Cooper stated that the developer disagreed with the PD requirement of 40%hard surface
material on the structures;they wish to use 20%.Chad Weaver explained the City's position that the
PD allowed for concessions such as increased density and decreased building separation,and that the
40%hard surface requirement would be to the City's benefit.Commissioner Hoifeldt proposed that
40%be required on the outer 2-story buildings and 20%on the inner 3-story buildings.Chairman
Steele expressed his desire for hard surface materials at ground level along the entire perimeter of the
buildings,rather than having certain areas with siding at ground level.Commissioner Schmidt stated
his reluctance to allow less than 40%,especially after the amount of work done recently by the
Commission and City Council to revise City ordinances to increase the minimum hard surface
material.Commissioner Korpanty agreed with Commissioner Schmidt.Commissioner White felt that
recent ordinance changes should not necessarily be applied to projects that began the approval process
prior to the ordinances being enacted.
Commissioner Schmidt stated his concern that car headlights would shine into the single family homes
and requested fencing between the garages along the eastern border of the development.Chad Weaver
asked if the developers had accounted for the required number of handicap-accessible parking spaces.
Mr.Cooper stated that they had not,but would do so prior to site plan resubmittal.The Commission
was also assured that the buildings will require sprinkling.Motion by Commissioner Schmidt,
seconded by Commissioner Hoifeldt,to "Approve the Rezoning for Williams Pointe Condominiums
from R-3 (Multi-Family Residential)to PD-l (Planned Development Overlay District),with the
addition of non-light permeable fencing at the ends of the garage drives along the eastern edge ofthe
development."Ayes:Korpanty,Schmidt,Steele.Nays:Hoifeldt,White.Motion carried.
Approve the Landscape Maintenance Ordinance.Chad Weaver explained that §401.4 would be
amended to add a section regarding landscape maintenance for all projects requiring a site plan (all
zoning districts but A-I,R-I and R-2).Motion by Commissioner Korpanty,seconded by
Commissioner Schmidt,to "Approve the Landscape Maintenance Ordinance."Ayes:Hoifeldt,
Korpanty,Schmidt,White,Steele.Nays:None.Motion carried.
Discuss the Rezoning of Portions of Koethe Property from R-3 (Multi-Family Residential)to R-2
(One and Two Family Residential),R-4 (Row Dwelling and Condominium Dwelling)to R-2 (One
and Two Family Residential),and C-IA (Neighborhood Commercial)to R-3 (Multi-Family
Residential).Chad Weaver stated that this would be a potential city-initiated rezoning.The rezoning
would allow for more single family homes and move any future townhome developments nearer
University Ave.Mr.Koethe had not been notified as yet ofthe City's intent to rezone,but he would
be notified if the Commission felt that the rezoning should proceed.The rezoning would still conform
with the City's Comprehensive Plan.Rick Ross addressed the Commission,stating that Jerry's Homes
would be developing just south of the Koethe property in question,and that they would be rezoning the
easternmost portion of the property to allow multi-family and townhome development.
Commissioners Hoifeldt,Korpanty,Schmidt,White and Steele all indicated their approval of the
rezoning of the Koethe property.

New Business.Commissioner Schmidt noted that he and Commissioners Willits and Steele attended
the City Council meeting of September 22,2003 to discuss the increased hard surface requirements for
site plans.

8:35 p.m.Ayes:Hoifeldt,Korpanty,Schmidt,White,Steele.Nays:None.Motion carried.Meeting
