MINUTES OF THE TUESDAY,OCTOBER II,2005 PLANNING AND ZONING COMMISSION
MEETING.
Vice Chairman Hoife1dt called the October II,2005 meeting of the Planning and Zoning Commission to
order at 7:02 p.m.
Roll Call.Vice Chairman Hoifeldt asked for a roll call and the following Commissioners were present:
Dutcher,Hoifeldt,Mook,Schmidt,Wilson.Absent:Krantz,Steele.Council Representative:None.
Chairman Steele arrived at 7:04 p.m.Commissioner Krantz arrived at 7:08 p.m.
Agenda Approval.Motion by Connnissioner Schmidt,seconded by Commissioner Dutcher,to
"Approve the Agenda for October II,2005."Ayes:Dutcher,Hoifeldt,Mook,Schmidt,Wilson.Nays:
None.Motion carried.
Approval of September 27,2005 Meeting Minutes.Motion by Commissioner Sclnnidt,seconded by
Commissioner Wilson,to "Adopt the September 27,2005 Meeting Minutes with the correction that
'roofline'be changed to 'ridgeline'in the discussion of the rezoning of Williams Pointe Plat 9."Ayes:
Dutcher,Hoifeldt,Mook,Schmidt,Wilson,Steele.Nays:None.Motion carried.
Open Forum.No one appeared to address the Commission during the Open Forum.
Approve the Rezoning of Williams Pointe Plat 9 from C-IA [Neighborhood Commercial District]to
C-IA [Neighborhood Commercial District]and R-3 [Rental Multi-Family Residential District],then
to PD-l [Planned Development Overlay District].Chad Weaver introduced the rezoning application.
Also in attendance were Erin Ollendike of Civil Design Advantage (CDA)and Todd Wiskus of Simonson
and Associates.Connnissioner Krantz arrives at 7:08 p.m.There was much discussion of the revised
elevations of the mixed use building.Commissioner Schmidt stated his desire to eliminate all vinyl siding
on the commercial elevations,and limit its use on the residential elevations.Addressing one of the City
staff comments,Ms.Ollendike stated that the lack of benning along the western sides of Lots 3 and 4 was
due in part to the location of the pond.Commissioner Sclnnidt mentioned that the intersection of Alice's
Rd.and University Ave.was being considered as a "focal point"intersection,and as such special
landscaping features should be addressed.Commissioner Hoifeldt asked if a fountain was planned for the
pond;Mr.Wiskus replied that it had not yet been considered.Ms.Ollendike also stated that the pond
would be approximately 9 feet below grade and 12 feet deep.Chairman Steele stated his desire for a
landscaping plan for the pond area,especially due to the high visibility it would have at this particular
intersection.There was some discussion as to the ownership of and responsibility for the pond.
Currently,the property lines for Williams Pointe Plat 9 separate pond ownership among Lots 3 and 4 and
public right-of-way.Mr.Weaver stated that the property lines would need to be redrawn so that one
entity would have complete ownership of and responsibility for the pond.The Commission again
discussed the proposed mixed use building.Commissioner Wilson expressed concern that fire trucks may
not be able to access the rear of the building due to the turning radii.Mr.Wiskus stated that due to the
size and mixed use of the building,fire walls would be required and the building would have a sprinkler
system.Mr.Wiskus also explained that the building would be built in phases.Commissioner Schmidt
replied that each phase would need to be constructed as a "complete"building,without temporary caps on
the ends.Commissioner Schmidt also stated his desire to eliminate the use of parapet roofs from the
development and allow only pitched roofs.Motion by Commissioner Schmidt,seconded by
Commissioner Krantz,to "Approve the Rezoning of Williams Pointe Plat 9,Lots I through 5 to C-IA
[Neighborhood Commercial District]and Lot 6 to R-3 [Rental Multi-Family Residential District]."Ayes:
Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson,Steele.Nays:None.Motion carried.Motion by
Commissioner Schmidt,seconded by Commissioner Hoifeldt,to "Approve the Rezoning of Williams
Pointe Plat 9 to PD-I [Planned Development Overlay District]provided:I)no vinyl siding is allowed on

any elevations containing any commercial nses,2)vinyl siding is allowed on elevations containing
residential uses,3)the "focal point"concept for the pond area is to be worked out with City staff,and 4)
rooflines shall have similar architectural styles and roofing materials,with no parapet rooflines allowed."1
Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson,Steele.Nays:None.Motion carried.I
Approve the Rezoning of 620 Walnut St.from R-3 [Rental Multi-Family Residential District]to C-I
[Community and Highway Service Commercial District].Chad Weaver introduced the rezoning
application.Also in attendance was John Harrington,applicant and owner of the property in question.
Mr.Harrington proposes a plumbing contracting business on the site,with future office/retail uses at the
front of the lot and a warehouse at the back of the lot.There will be no outside storage.Mr.Weaver
explained that due to the nature of a phunbing contracting business and a warehouse,the proposed use
would not be appropriate in a C-IA or C-2 zoning district,which is the zoning of adjacent commercial
properties.Commissioner Hoifeldt said that he struggled with the idea of expanding the downtown
commercial district to the west into a residential area.Mark Arentsen stated that he was not as concerned
with the current proposed use,but with what types of business would be allowed in the future if Mr.
Harrington were to sell the property with C-l zoning.Commissioner Schmidt expressed his concern in
allowing a use that he saw as industrial within commercial zoning.He asked if the site would be held to
C-l building standards;Mr.Weaver replied that it would be held to the C-2 standards of the adjacent
properties,and that such standards were more lenient than those for C-l.Commissioner Hoifeldt asked if
the rezoning could be conditional so that if Mr.Harrington were to sell the property,the zoning could
revert to more limited uses.Mr.Weaver stated that there may possibly be legal issues with such
conditional rezoning;Commissioner Schmidt stated that it would be difficult to enforce,as a property
owner is not required to inform the City when a property sale takes place.Mr.Harrington stated that he
had good support from the surrounding property owners.Lyn Shaffer,owner of Classic Floral,addressed 1
the Commission to express her support for Mr.Harrington's application,stating that he had been an I'
excellent neighbor.Motion by Commissioner Hoifeldt,seconded by Commissioner Krantz,to "Approve
the Rezoning of 620 Walnut St.from R -3 [Rental Multi -Family Residential District]to C-l [Community
and Highway Service Commercial District]."Chairman Steele asked for a role call vote.Ayes:Dutcher,
Krantz,Mook,Steele.Nays:Hoifeldt,Sclunidt,Wilson.Motion carried.
Approve the Re-adoption of the Official Zoning Map.Chad Weaver introduced the item.Motion by
Commissioner Hoifeldt,seconded by Commissioner Sclnnidt,to "Approve the Re-adoption of the
Official Zoning Map."Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Wilson,Steele.Nays:None.
Motion carried.
Discuss the Rezoning of West Central Auto Auction/Scaglione Properties from A-I [Agricultural
District]to a Commercially-Zoned District.Chad Weaver introduced the rezoning discussion.Also in
attendance were Frank Scaglione,owner of the property,and Leo Pelds ofPelds Engineering Co.When
Mr.Scaglione agreed to annex into the City in 2000,it was with the stipulation that he be granted
commercial zoning.Mark Arentsen stated that the property adjacent to Mr.Scaglione to the north was
being planned as a residential development,and that rezoning the Scaglione property at this point would
also benefit the northem property owners in knowing what uses would be allowed to the south of their
development.Mr.Weaver explained that City staff recommended the rezoning go forward as C-l
[Community and Highway Service Commercial District],with the stipulation that a PD-l overlay be
required when future development is planned.The City Attorney will be drafting an ordinance to address I
this provision.Mr.Weaver also stated that the Commission may want to limit certain principal uses in JI
the PD,but that West Central Auto Auction would still be allowed.NIT.Pelds addressed the Commission,
stating his desire to move the Auto Auction without having to plan the rest of the property,

New Business.Chad Weaver stated that the Commission may want to readdress the approval of the
rezoning of 620 Walnut St.at the next regular meeting so that any recommendations to City Council
regarding possible limitations or time restrictions to the rezoning can be articulated.
Commissioner Hoifeldt requested that the Commission discuss design standards for focal point features at
major thoroughfare intersections during the next regular meeting,specifically for the Alice's
Rd.lUniversity Ave.intersection.Chairman Steele asked if a special consultant would be needed to help
with the design;Mr.Weaver stated that Veenstra &Kimm could be employed for the purpose of creating
initial concepts.
