Chairman Hoifeldt called the October 23,2007 meeting of the Planning and Zoning Commission to order at 7:00 p.m.I Roll Call.Chairman Hoifeldt asked for a roll call and the following Commissioners were present: Hoifeldt,Dutcher,Steele,Mook,Schmidt,Wilson,and Airhart.Absent:None.Others in attendance: Beth Richardson,Brad Deets,Ben Landhauser,and Dennis Dowell. Agenda Approval.Motion by Commissioner Schmidt,seconded by Conunissioner Airhart,to "Approve the Agenda for October 23,2007."Ayes:Schmidt,Airhart,Steele,Mook,Wilson,Dutcher, and Hoifeldt.Nays:None.Motion carried. Approval of September 25,2007 Regnlar Meeting Minntes.Motion by Commissioner Mook, seconded by Commissioner Wilson to "Adopt the September 25,2007 Regular Meeting Minutes." Ayes:Mook,Wilson,Steele,Scbmidt,Airhart,Dutcher,and Hoifeldt.Nays:None.Motion carried. Open Forum.No one appeared to address the Conunission during the Open Forum. Motion to Approve the Rezoning for a parcel of land from A-I Agricnltural District to C-4 Office Park Commercial District and PD-I Planned Development District (KC Holdings Commercial Development -Schwartz Property).Director of Planning,Brad Deets,briefly explained the request for rezoning of tins property.The applicant is requesting approval of a rezoning of approximately 5 acres of ground from A..-I Agricultural District to C-4 Office Park COIP-LLl11ercialDistrict and PD-l Planned Development Overlay District.The property is located north of University Avenue and approximately 500 feet west of Waco Place.Bill Murphy with Strategic Design,representing KC Holdings,Inc.,reviewed the proposed rezoning stating that the developer has every intention of saving as many of the existing trees as possible during the development of the property.Bishop Engineering has surveyed and labeled the trees within the proposed development.The developer intends to keep the three rows of trees along the three sides of the development and was open to the idea of revising the development agreement to state that no trees would be removed within the north 30 foot setback in order to preservethe trees extending outside of the 25 foot landscapebuffer.The development will contain 4 office buildings with a similar theme;the developer intends to use primarily all hard surface huilding materials on the outside of the building including brick,stone,and glass.The Conunission recommended that a 4"residential brick or stone be used on all the buildings.Motion by Commissioner Steele,seconded by Conunissioner Airhart to "Approve the Rezoning for a parcel of land from A-I Agricultural District to C-4 Office Park Commercial District and PD-I Planned Development District (KC Holdings Commercial Development -Schwartz Property)."Motion by Commissioner Steele,seconded by Commissioner Airhart to "Amend the motion to include the use of residential brick in the building elevations and to include that the City has to approve the removal of the trees in the development area".Ayes:Steele,Airhart,Mook,Schmidt,Hoifeldt,Dutcher,and Wilson.Nays:None.Motion carried. Motion to Approve the Rezoning for a parcel of land from R-4 Row Dwelling and Townhome Dwelling District and PD-I Planned Development District to R-3 Rental Multi-Family Residential District and PD-l Planned Development District (Wiliiams Pointe Plat 12).Director of Planning,Brad Deets,briefly explained the applicants request for rezoning.The applicant is requesting a rezoning approval of a property to accommodate an apartment development.The subject property is included in the Williams Pointe Planned Development that was approved by the City of I 241 Waukee in July 2005.The property has previously been platted as a part of Williams Pointe 12 and is currently zoned R-4 Row Dwelling and Attached Dwelling District with a Planned Development Overlay.The rezoning request would be to change the zoning to R-3 Rental Multi-Family Residential District with a Planned Development Overlay.The property is generally located south of SE Laurel Street and west of SE Brick Drive containing approximately 14.14 acres more or less.Tom Howard of Riekes Materials spoke about concerns he had with the cul-de-sac area being near the play area and the possibility of children being exposed to semi traffic.He was pleased to see some additional screening placed between the proposed play area and the cul-de-sac and would like to see no parking signs placed along Westbrook and within the cul-de-sac area.Motion by Commissioner Schmidt,seconded by Connnissioner Wilson to "Approve the Rezoning for a parcel ofland from R-4 Row Dwelling and Townhome Dwelling District and PD-l Planned Development District to R-3 Rental Multi-Family Residential District and PD-l Planned Development District (Williams Pointe Plat 12)subject to remaining staff comments."Ayes:Schmidt,Wilson,Mook,Steele,Airhart,Hoife1dt,and Dutcher. Nays:None.Motion carried. Motion to Approve the Final Plat for Stone Prairie Plat 1.Director of Planning,Brad Deets, briefly explained the applicants request for approval of a final plat for the development of Stone Prairie Plat 1.The final plat also indicates three (3)outlots for future development.The plat is generally located west of SE LA Grant Parkway and south of SE Westown Parkway (3lih Place)containing approximately 24.63 acres.The applicant anticipates the remaining public improvements will be completed by the November 5,2007 City Council meeting with the exception of the portion of SE Westown Parkway included as a part of this project which will not be able to be constructed before next SpIIDg due to the closing and construction of SE LA Grant Parkway adjacent to this project.The applicant will be required to bond for the necessary improvements to SE Westown Parkway.Motion by Commissioner Wilson,seconded by Commissioner Dutcher to "Approve the Final Plat for Stone Prairie Plat 1 subject to the completion of remaining public improvements and an acceptable agreement regarding parkland dedication and improvements."Ayes:Wilson,Dutcher,Schmidt, Mook,Steele,Hoifeldt,and Airhart.Nays:None.Motion carried. New Business.The University Avenue reconstruction project will begin soon closing University Avenue intermittently to install cross runs.Shottenkirk Development has moved the bike trail along the east side of 6th Street as a part of their site plan proposal.The final public meeting for the Comp Plan is scheduled for December 4,2007 prior to the P &Z and Council approval ofthe documents.
