Chairman Steele called the October 25,2005 meeting of the Planning and Zoning Commission to order at 7:00p.m. Roll Call.Chairman Steele asked for a roll call and the following Commissioners were present:Dutcher, Hoifeldt,Krantz,Mook,Schmidt.Absent:Wilson.Council Representative:Mertz. Agenda Approval.Motion by Connnissioner Schmidt,seconded by Connnissioner Mook,to "Approve the Agenda for October 25,2005."Ayes:Dutcher,Hoifeldt,Krantz,Mook,Schmidt,Steele.Nays: None.Motion carried. Approval of October 11,2005 Meeting Minutes.Motion by Commissioner Krantz,seconded by Commissioner Sclnnidt,to "Adopt the October 11,2005 Meeting Minutes."Ayes:Dutcher,Hoifeldt, Krantz,Mook,Schmidt,Steele.Nays:None.Motion carried. Approval of October 18,2005 Special Meeting Minutes.Motion by Connnissioner Hoifeldt,seconded by Commissioner Krantz,to "Adopt the October 18,2005 Special Meeting Minutes."Ayes:Dutcher, Hoifeldt,Krantz,Mook,Schmidt,Steele.Nays:None.Motion carried. Open Forum.No one appeared to address the Commission during the Open Forum. Discuss the Rezoning Application of 620 Walnut St.from R-3 [Rental Multi-Family Residential District]to C-l [Community and Highway Service Commercial District].The rezoning for the property in question had been approved by the Commission during the regular October 11,2005 meeting. After the approval,it was suggested by City staff that the Commission review the rezoning approval to see if any limitations or caveats should be reconnnended and forwarded to City Council.John Hanington,owner of the property,was notified of the Commission's intent to discuss the issue,but was not in attendance.Chairman Steele reminded the Commission that he had initially voted in favor of the rezoning,but would now favor limitations.Connnissioner Krantz agreed that limitations were needed; reiterating his belief that commercial zoning for the property in question would improve the area and encourage downtown business.Commissioner Hoifeldt read aloud some of the C-l and C-IA uses that he felt would be inappropriate for the property,and restated his position that the alleyway to the east of the property made a good buffer between commercial and residential uses.Commissioners Hoifeldt and Schmidt both reiterated that they were against the rezoning,but that if it was to go forward,they would support limitations.Commissioner Mook agreed that limitations were necessary,and stated that a development timeline should be recommended as well.Dennis Dowell explained that the property was currently being used for commercial purposes in residential zoning,and therefore violated the zoning ordinance.The Commission also discussed the fact that the property appeared to be for sale,and questioned ifthe owner was trying to sell it as commercial or residential.Chad Weaver agreed to contact the owner to discuss his intentions for the property,The Commission then made the following recommendations regarding the rezoning:1)an approved building permit for site improvements must be obtained within 6 months of rezoning approval,with construction to begin within 1 year of rezoning approval;otherwise,the zoning reverts back to R-3;2)on-street parking is required along Walnut St.for the entire length of the lot,with paving to be done by the owner;3)no ovemight commercial on-street parking is allowed,and 4)the following principal uses are eliminated:animal hospitakbowling alley; funeral homes and mortuaries;gas stations;golf driving range andminiature golf courses;night clubs and tavems;new and used car sales and service excluding body repair and painting;automobile,trailer, motorcycle,boat,farm implement and lawn and garden establishments for display,hire,rental and sales (including sales lots);car wash;commercial swimming pools,skating rinks,golf driving ranges, 172 miniature golf courses,drive-in theaters and similar recreational uses and facilities;garage for general motor vehicle repair;liquor and beverage stores;motels and motor hotels;drive-in restaurants; recreational vehicle parks;truck stops;launderettes,coin-operated dry-cleaning establishments,and dry- cleaning or pressing establishments;and drive-in banks. Discuss the Design Standards for Focal Point Features at Major Thoroughfare Intersections.John Kursitis of Veenstra &Kinun handed out aerial photographs of certain metro area intersections that included focal point features or designs.The Commission also discussed the uniqueness and potential design limitations of the University Ave.!Alice's Rd.intersection.After much discussion,Mark Arentsen suggested a consultant be hired to review the entire Alice's Rd.corridor to come up with a consistent focal point theme.Chad Weaver questioned the cost of a consultant,stating that he would like to continue working with Veenstra &Kinun to design the corridor,provided the costs were reasonable.Mr.Arentsen then suggested a request for proposal (RFP)to see what the costs might be;the Commission will then be provided with a draft RFP for review.The Commission agreed to review the RFP at the next regular meeting. New Business.Commissioner Schmidt thanked Chad Weaver for his help and hard work,and wished him well in his new job in Omaha,NE.
