Jim Berner presented preliminary plat with explantion of intent of developers, A lengthy discussion,questions and answers was held with the guests concnerning the a.ffects of said development to the commund ty especially effects of street traffic regarding 8th Street and Cherry Streets and effect of development regarding sewers,storm and sanitary,effect of water supply in case of fire,and effect of children from development into school system, No official action was asked for or taken on preliminary plat as it was generally agreed all necessary requirements had not been met for submission of preliminary plat. Meeting adjourned. March 5,1979 Present:Claire Chedester,Dick Herbert,Bob Gallagher,Don Faust, Joe Powell and Vivian Wilson. Absent:Norma Franks Guest:Five town citizens,developers of Judy Ann Estates,Bud Gray. Preliminary plat plans and necessary papers have been presented previously to P &Z commission by developers of Judy Ann Estates. An open discussion was held regarding same.Questions presented were about the maintenance of the lift station in the event the condominiums failed.Jim Berner,on behalf of developers,stated that it would remain the responsibility of the owners of Judy Ann Estates area to maintain and operate the lift station as long of the lift station is necessary. The qeustion was raised and discussed at legth to the effect of what would happen if the condominiums should not be successful; would apartments be the next step?Could there be any assurance, such as a covenant that this wouldn't happen? Developers said completion date target is from two (2)to five (5) years on development. All requirements for preliminary plat have been met. Claire Chedester made the motion for approval of preliminary plat plan of Judy Ann Estates.Seconded by Joe Powell.Motion carried 6 to O. March 5,19~9--cont Motion by Dick Gerbert,seconded by Don Faust,to ask city council :-1 to give opinion of what will be the procedure for maintaining the surface of 8th Street,and tO'ask city engineer's op~n~on J on sewer back-up on Cherry St sewer,particularly the corner hourses on 6th &Cherry and if there is a possibility of a covenant to the effect that builders would not build apartments in the development.Motion carried. Motion made by Don Faust that if condominiums failed,remaining ground be reverted back to A-1 zoning.No action taken on motion. Bud Gray presented plan for four (4)lot in addition to previously submitted Plat 8 plans.Four (4)lots submitted as Plat 9. All requirements were met previously on Plat 8.Motion by Claire Chedester to approve addition,second by Don Faust.Approved. Suggestions for ordinance work to be revised and updated: 1.Condominium should be defined in zoning ordinance and is there a possibility of a separate zoning for condominiums. 2.Define tie downs in mobile home requirements.Specifically how many. 3.From the standpoint of public interest,P &Z feels there should be no zoning changes to R-3 until current ratio of I single housing to multiple housing changes.Motion to I that effect made by Faust and second by Chedester.Carried.. 4.When zoning change is proposed;property owners within 200 feet of proposed change need to be notified by mail of such proposal. 5.A requirement should be considered for making cats be required to have rabies vaccination. 6.Bob Gallagher asked for a printed form for signature of P &Z chairman to be attached to plans approved. Motion for adjournment by Dick Herbert,second by Joe Powell.Carried.
