Chairman Schmidt called the February 9,2010 meeting of the Planning and Zoning Commission to order at 6:00p.m. Roll Call.Chairman Schmidt asked for a roll call and the following Commissioners were present: Hoifeldt,Mook,Airhart,Johnson (6:07 PM),McCulloh (6:05 PM),Borne,and Schmidt.Absent:None. Others in attendance:Beth Richardson,Ben Landhauser,Dennis Dowell,John Kursitis,and Council Member Dutcher. Agenda Approval.Motion by Commissioner Airhart,seconded by Commissioner Hoifeldt,to approve the agenda for February 9,2010."Ayes:Airhart,Hoifeldt,Mook,Johnson,Borne,McCulloh,and Schmidt.Nays:None.Motion carried. Approval of the January 26,2010 Regular Meeting Minutes.Motion by Commissioner Hoifeldt, seconded by Commissioner Airhart to adopt the January 26,2010 Regular Meeting Minutes."Ayes: Hoifeldt,Airhart,Johnson,Borne,McCulloh,Mook,and Schmidt.Nays:None.Motion carried. Approval of the January 14,2010 Minutes of the Parks Comprehensive Plan Consultation Meeting. Motion by Commissioner Airhart,seconded by Commissioner Johnson to adopt the January 14,2010 Minutes of the Parks and Comprehensive Plan Consultation Meeting."Ayes:Airhart,Johnson,Hoifeldt, Borne,McCulloh,Mook,and Schmidt.Nays:None.Motion carried. Opeu Forum.No one appeared to address the Commission during the Open Forum. Memory Care Facility at Legacy Pointe.City Planner,Ben Landhauser,explained both the final plat and the site plan together.The project involves the platting of Outlot Z of Legacy Pointe at Waukee Plat 5 to accommodate a memory care facility.The property is approximately 3.15 acres.Additional street right-of-way,identified as Lot A on the proposed plat,will be dedicated to the City for the permanent termination of SE Golden Harvest Drive. The project involves the construction of a new 12,325 square foot Memory Care Facility on Lot I of the proposed Legacy Pointe Plat 6.The applicant has indicated that a second phase is anticipated at some time in the future.A footprint identifying the size and area the future phase will likely occupy has been identified on the site plan.Should the applicant pursue an addition in the future,they would be required to submit another site plan for Commission and Council consideration. Commissioner Schmidt stated he liked the overall layout and building style of the site.The green space exceeds the minimum required for the development and is impressed with the variety and species of trees and shrubs chosen for the site.The exterior elevations for the building will be consistent with the adjacent townhome development.Commissioner Mook expressed concern with the need for additional parking.Ben Landhauser explained that additional parking would be required on the site when it creates a forced hazard for the area.Also,Ben noted that parking would not be allowed in the back alley. Commissioner Johnson expressed concern with the grading in the area of the detention ponds on both sides of the cul-de-sac.Brad Uitermarkt with Garden and Associates explained that the detention area is designed for greater than the 100 year flood and the drainage flows to the public storm water intakes. Bob Cooper,president of the Legacy Pointe Townbome Association,stated that the bulk (70%)of the townhome owners in the area are in favor of the project.However,he expressed concern with the potential of having too much berming and plantings along the alley way.The association fears that a berm would negate efforts to push snow out of the alley using this winters snowfall as an example of how high and difficult the snow removal efforts could become if the berm was too high to push snow over. a)Approval of the Final Plat for Legacy Pointe at Waukee Plat 6.Motion by Commissioner Hoifeldt,seconded by Commissioner Mook to "Approve the Final Plat for Legacy Pointe at Waukee Plat 6."Ayes:Hoifeldt,Mook,Airhart,Johnson,McCulloh,Borne,and Schmidt.Nays: None.Motion carried. Motion by Commissioner Hoifeldt,seconded by Commissioner Mook to "Amend the motion to approve the Final Plat for Legacy Pointe at Waukee Plat 6 subject to the review of legal documents by the City Attorney".Ayes:Hoifeldt,Mook,Airhart,Johnson,McCulloh,Borne, and Schmidt.Nays:None.Motion carried. b)Approval of the Site Plan for Waukee Memory Care.Motion by Commissioner Airhart, seconded by Commissioner Johnson to "Approve the site plan for Waukee Memory Care."Ayes: Airhart,Johnson,Hoifeldt,McCulloh,Bome,Mook,and Schmidt.Nays:None.Motion carried. New Business.No new business was presented.
