MEETING.
Chairman Mook called the March 10,2009 meeting of the Planning and Zoning Commission to order at
6:05 p.rn.
Roll Call.Chairman Mook asked for a roll call and the following Commissioners were present:
Hoifeldt,Mook,Schmidt,Steele,and Airhart.Absent:Dutcher and Hassebroek.Others in attendance:
Brad Deets,Ben Landhauser,John Kursitis,Councilmen Don Bailey,Linda Stewart,David and Kathleen
Cady,Juue Andeberg and John Aukes.
Agenda Approval.Motion by Commissioner Schmidt,secouded by Commissioner Airhart,to "Approve
the Agenda for March 10,2009 changing agenda item six from a Motion to Discussion."Ayes:Schmidt,
Airhart,Hoifeldt,Steele and Mook.Nays:None.Motion carried,
Approval of the February 24,2009 Regnlar Meeting Minntes.Commissioner Steele identified minor
corrections that needed to be made to the minutes prior to approval.Motion by Commissioner Schmidt,
seconded by Commissioner Airhart to "Adopt the February 24,2009 Regular Meeting Minutes subject to
the revisions identified."Ayes:Schmidt,Airhart,Hoifeldt,Steele and Mook.Nays:None.Motion
carried,
Open Forum.No one appeared to address the Commission during the Open Forum.
Motion to Approve the Reqnest for Rezoning of Property from A-I Agricnltnral District to R-2 One
and Two Family Residential District -Clayton Commons.Director of Development Services,Brad
Deets,reviewed the proposed rezoning of an approximately 6 acre parcel owned by the City of Waukee
from A-I Agricultural District to R-2 One and Two Family Residential District.The City of Waukee
purchased approximately 100 acres of property from what was formerly a Clayton farm in 2007.Twenty
acres of the property has been sold to the Waukee Community School District for the development of a
new elementary school to replace the existing Waukee Elementary located off of 4"'Street.As a part of
the development of the school property,located on the southwest corner of 6"'Street and Northview
Drive,improvements to 6"'Street will be made as well as an extension of Northview Drive from 6"'Street
to the west.The extension of Northview Drive will create an approximate six acre parcel of ground that
is best suited for single family homes.The rezoning will allow for the development of nine residential
lots at the time improvements are completed to Northview Drive and connections are made to 7"'and 8"'
Street.The rezoning will also permit an additional nine to ten lots to be developed in the future as
Northview Drive is extended to west property line of the City property.June Andeberg,property owner
at 660 6"'Street expressed concern to the Commission that the proposed rezoning would create lots
without adequate room for new homes to be built with proper separation from existing homes adjacent to
the property.June Andeberg specifically expressed concem that her neighbor at 720 6"'Street whose
horne is currently located very close to the southem property line and would be very close to any new
horne built on the current City property.Brad Deets explained that the absolute minimum setback from
the property owner at 720 6"'Street to a new horne in the proposed Clayton Commons lots would be 37
feet assuming that the existing horne on 6"'Street met the minimum side yard setback requirement of 7
feet.It was also noted that this separation distance is common in current neighborhoods where adjacent
homes have a side yard and rear yard separating homes on a street comer.Kathleen Cady,property
owner at 640 6"'Street,addressed the Commission with questions related to the proposed 6"'Street
improvements with regard to the extent of improvements north of the Northview Drive intersection.John
Aukes,property owner at 835 Spruce Street,expressed concem to the Commission about the size of the
proposed lots and questioned whether alternative land uses had been contemplated for the portion of
property proposed for rezoning.Mr.Aukes further questioned how the development of new residential
homes would affect the drainage of his property due to the existing swale that runs in the rear of his
property.Brad Deets explained that the proposed lot sizes will be very compatible in depth to the existing
homes in the Southview Estates development and will have more width in most cases than the existing
lots in Southview Estates.Also identified were the future plans of the City to develop the majority of the
remaining property south of Northview Drive into open space or recreational type uses,but the intent of
the property proposed to be rezoned as Clayton Commons had always been intended to be developed for
residential use as the size and shape of the parcels are not conducive to most other uses.It was explained
that the development of any new residential property would be engineered in a manner that would keep
storm water from flowing onto existing properties.Motion by Commissioner Schmidt and seconded by
Commissioner Steele to "rezone the proposed 5.92 acres from A-I Agricultural District to R-2 One and
Two Family Residential District subject to a provision that construction on the lots be limited to single
family development.Ayes:Airhart,Schmidt,Hoifeldt,Steele,and Mook.Nays:None.Motion carried.
Discussion.Zoning Ordinance Amendment to Section 301.9:"A-l Agricultural District regarding
provisions for farm winery.The Commission had continued discussion related to the proposed
revisious to the A-I Agricultural District regarding provisions to regulate a farm winery use that had been
presented at the February 24,2009 meetiug.Staff had prepared revisious to the previous amendment
language presented and requested further guidauce from the Commissiou as to their opiuiou of regulating
the winery use.The Commission again expressed interest in allowing for this type of use with in the
corporate limits of Waukee,but had hesitation as to whether the proposed amendment properly regulated
the use from haviug an adverse affect on the community.Discussion amongst the Commissioners
included relative correlation the winery use had to other retail businesses,agricultural aud nursery sales,
and private events held at homes of existing residents.
Discussion.Zoning Ordinance Updates.Director of Development Services,Brad Deets explained to
the Commission that additional ordinance revisions would be presented to them in the coming months.
The Commission also took the opportunity to discuss the revisions to the PD-I Planned Development
Ordinance that were presented initially at the February 24,2009 meeting.Commissioner Schmidt
requested that the LEED Checklist be added as item to the minimum requirements of a development plan
submitted as a part of a PD-I zoning request.The Commission questioned whether
stipulations should be provided related to the termiuation clause of the ordinance to allow City Council to
grant an extension to a PD-I district should a proposal lack any substantial development three years after
the granting of the zoning classification.
New Business.Director of Development Services,Brad Deets updated the Commission on upcoming
City projects including the 6th Street and Nortbview Drive improvements necessary for the development
of the uew Waukee Elementary School.The Conunissiou was also reminded of the Downtown Master
Plan Open House meeting.Commissioner Hoifeldt requested that staff by to have representatives from
the Downtown Alliance involved in the combiued meeting with Council wheu the document is presented
for adoption.
