Roll Call.The Chairman asked for a roll call and the following Board Members were present:Ellis, Lohstreter,Oxenford.Absent:Colter,Phillips.Council Representative present:Stanton. Approve the January 24,2005 Agenda.Motion by Ellis,seconded by Lohstreter,to "Approve the January 24,2005 Agenda."Ayes:Ellis,Lohstreter,Oxenford.Nays:None.Motion carried. Approve the November 13,2003 Board of Adjustment Minutes.Motion by Ellis,seconded by Lohstreter,to "Approve the November 13,2003 Board of Adjustment Minutes."Ayes:Ellis, Lohstreter,Oxenford.Nays:None.Motion carried. Approve the Application of Shottenkirk Chevrolet -755 W.Highway 6.Tony Baxter of Baxter Construction addressed the Board on behalf of Shottenkirk Chevrolet.The applicant is requesting a variance from Waukee Municipal Code §305.3(6)which states that monument signs must be erected with a minimum setback of 15 feet from the property line in an area zoned C-I (Community and Highway Service Commercial District).An unfinished monument sign has already been erected within the setback,and without a building permit.Mr.Baxter stated that erecting the sign within the setback would place the sign in the parking lot,causing the loss of vehicle display space and decreased visibility for the sign.Mr.Baxter also stated that the sign would be temporary until a new site plan for the entire property was submitted to and approved by the City.He requested that the variance at least be allowed until the site is redeveloped.Chairman Oxenford and Board Member Ellis stated that a similar application for Westwood Plaza for a monument sign within the setback had been denied by the Board.Board Member Colter,who was absent from the meeting,asked that the Board be informed of his opinion that the variance should be denied as the applicant did not receive a building permit prior to erecting the sign,similar applications have been denied in the past,and that approving such a variance would not be consistent with what the City wanted.Chairman Oxenford reviewed the criteria to be met in order to gain approval for a variance;the Board agreed that none of the criteria were met.Mr. Baxter asked that if the variance was denied,they be allowed 30-45 days to remove the sign due to the cold weather.Chairman Oxenford stated that the applicant would need to work with City staff to set a date for removal.Motion by Ellis,seconded by Lohstreter,to "Approve the Application of Shottenkirk Chevrolet -755 W.Highway 6."Chairman Oxenford asked for a roll call vote.Ayes:None.Nays: Ellis,Lohstreter,Oxenford.Motion defeated;variance denied. Old Business.None. New Business.None. Adjournment.Motion by Ellis,seconded by Lohstreter,to adjourn at 5:18 p.m.Ayes:Ellis, Lohstreter,Oxenford.Nays:None.Motion carried.Meetin adjourned.
