MINUTES OF THE APRIL 26,2007 BOARD OF ADJUSTMENT MEETING
The April 26,2007 Board of Adjustment meeting was called to order at 5 :30 p.m.by Chairman
Oxenford.
Roll Call.The Chairman asked for a roll call and the following Board Members were present:
Lohstrctcr,Ellis,Oxenford,Phillips.Absent:Colter.Others in attendance:Shannon Lynch,Brad
Deets,Dennis Dowell,Ben Landhauser.Council Member Mertz arrived at 5 :34 p.m.
Approve the April 26,2007 Agenda.Motion by Board Member Lohstreter,seconded by Board
Member Phillips,to "Approve the April 26,2007 Agenda."Ayes:Lohstreter,Ellis,Oxenford,
Phillips.Nays:None.Motion carried.
Approve the December 27,2006 Board of Adjustment Minutes.Motion by Board Member
Ellis,seconded by Board Member Phillips,to "Approve the December 27,2006 Board of
Adjustment Minutes."Ayes:Lohstreter,Ellis,Oxenford.Phillips.Nays:None.Motion carried.
Approve the Application for Troy Graen,5 Sngar Creek Lane -Side Yard Setback Variance.
Chairman Oxen ford questioned why this property fell under A-I [Agricultural District]Zoning and
asked Director of Planning Brad Deets for clarification about the annexation process.Mr.Deets
explained that all property annexed into the City is designated as A-I.Board Member Lohstreter
asked if the building department will be able to issue the permit for the house at this address without
a variance.Mr.Deets said the permit for the house could be issued without a variance.John
Heggen,Sugar Creek Board member,addressed the Board and told them the Sugar Creek Board
had no issues with Mr.Graen's request.Chairman Oxenford reviewed the criteria to be met in
order to gain approval for a variance.Motion by Board Member Ellis,seconded by Board Member
Lohstreter,to "Approve the Application of Troy Graen,5 Sugar Creek Lane -Side Yard Setback
Valiance."Chairman Oxenford asked for a roll call vote.Ayes:Ellis,Phillips,Oxenford,
Lohstreter.Nays:None.Motion carried;variance approved.
Old Business.Chairman Oxenford informed the Board that Board Member Ellis had been
reappointed to another five-year term on the Board of Adjustments.
New Business.None.
Adjournment.Motion by Lohstreter,seconded by Ellis,to adjoum at 5:50 p.m.Ayes:Lohstreter,
Phillips,Oxenford,Ellis.Nays:None.Motion carried.Meeting adjoumed.
