HomeMy WebLinkAbout2005-05-26-Board of Adjustment MinutesMINUTES OF THE MAY 26,2005 BOARD OF ADmSTMENT MEETING The May 26,2005 Board of Adjustment meeting was called to order at 5:00 p.m.by Chairman Oxenford.)Roll Call.The Chairman asked for a roll call and the following Board Members were present:Ellis, Lohstreter,Phillips,Oxenford.Absent:Colter.Council Representative:Stanton. Approve the May 26,2005 Agenda.Motion by Lohstreter,seconded by Ellis,to "Approve the May 26,2005 Agenda."Ayes:Ellis,Lohstreter,Phillips,Oxenford.Nays:None.Motion carried. Approve the March 31,2005 Board of Adjustment Minutes.Motion by Ellis,seconded by Phillips, to "Approve the March 31,2005 Board of Adjustment Minutes."Ayes:Ellis,Lohstreter,Phillips, Oxenford.Nays:None.Motion carried. Approve the Application of Tom Gordon -25 Marshall Drive.Tom Gordon of25 Marshall Drive addressed the Board.He has filed for a variance from §301.8(M)which states that "no fence,wall or hedge shall exceed four (4)feet in height along the street side yard of a comer lot within the area of the front yard extended of an abutting lot to the rear of said comer lot,unless located along building setback lines in which case the fence,wall or hedge shall not exceed the height of six (6)feet."Mr. Gordon wishes to erect a six (6)foot fence along the Warrior Lane side of his lot within the building setback.Board Member Phillips stated that a 6 foot fence along Warrior Lane would be consistent with the existing fencing along the corridor,and that a 4 foot fence might look out of place.Chairman Oxenford reviewed the criteria to be met in order to gain approval for a variance;the Board concurred that Mr.Gordon would be denied a privilege granted in the past to his surrounding neighbors.\ Chairman Oxenford then stated that the City Council had passed an ordinance on May 16,2005 )1 clarifying that 6 foot fences are not allowed in any front yard building setback;his belief is that Mr. Gordon had applied for a permit prior to that date and should therefore be allowed a variance,but any applications after May 16,2005 should be denied by the City.Board Member Lohstreter asked Council Representative Stanton if the City Council had considered different fencing regulations along arterial corridors.Council Representative Stanton replied that it had been discussed,but that the Council decided it would be better to enforce the same regulations for all lots,no matter what their location along a particular type of street.Mr.Dan Rutz of 10 Marshall Drive addressed the Board and stated his support for the variance.Motion by Colter,seconded by Phillips,to "Approve the Application of Tom Gordon -25 Marshall Drive."Chairman Oxenford asked for a roll call vote. Ayes:Ellis,Lohstreter,Phillips,Oxenford.Nays:None.Motion carried;variance approved. Old Business.The Board discussed the lack of progress on the fence at 565 SE Pleasant View Drive. Dennis Dowell stated that portions of the fence had been removed,but as yet Mr.Hall had not been approved for any fence permit.Mark Arentsen stated that if progress is not made soon,Mr.Hall would be charged with a violation ofthe City ordinance. The Board also asked about the status of the Shottenkirk sign.Mr.Arentsen stated that he had contacted the dealership and they were aware oftheir obligation to complete the sign by adding the brick around the base and sides.He also acknowledged that there was still time for them to complete the project.) JNewBusiness.Chairman Oxenford discussed a matter regarding the Waukee Middle School concession stand.He explained to the Board that the structure had been approved by the City with a certain color scheme,but that it had been built with different colored steel siding and shingles. Chairman Oxenford argued that the concession stand had been built with donations and volunteer Attest: labor,that it was a public building,and that the mistake in color should be overlooked.Mr.Arentsen, Mr.Dowell,and Council Representative Stanton replied that the structure simply had not been built as approved,and that the City had asked the school to paint the steel siding the color they had said it would be. Adjournment.Motion by Ellis,seconded by Lohstrcter,to adjourn at 5 :34 p.rn.Ayes:Ellis, Lohstreter,Phillips,Oxenford,Nays:None.Motion carried.Meeting adjourned.
