MR.MARK CUNNINGHAM -625 ASHWORTH DRIVE
The meeting was called to order at 6:30 pm.The following members were present:Schoeberl,
McCoige,Oxenford,White.Absent:Stone.
Schoeberl asked what other design criteria Mr.Cunningham had considered.Mr.Cunningham
explained why he wanted the roof at the height he proposed.
Kurt Rueckel,City Administrator was present and taking minutes.
McCoige asked for nominations for a new Chairman and Vice Chairman because McAtee is no longer
on the Board.White and McCoige received nominations for Chair.Motion by Oxenford,second
by White to elect McCoige as Chairman.Motion passed 4-0.
Motion by Schoeberl,second by McCoige to elect White as Vice Chair.Motion passed 4-0.Stone
will remain as secretary.
McCoige told the Board that he would abstain from this hearing due to a conflict of interest.
Vice Chair White noted that two letters were received in support of the applicant.Motion by
Oxenford,second by White to accept the letters of support from Sandra Sorensen of 645 Ashworth
Drive,and Michael and Jacquelyn Aldrich of 605 Ashworth Drive,second by Schoeberl.Upon voice
vote the motion passed 3-0.McCoige abstained.
Oxenford asked the applicant ifthere would be a second story since the height of the garage would
be twenty-two feet high.Mr.Cunningham stated that there would be storage space.He stated that
he wanted the height to make the garage look reasonable in the area.Oxenford expressed his concern
that this would be a two story accessory structure,which is not allowed in the Ordinance.
Rueckel stated that no other calls or letters had been received regarding this request.
Oxenford read the Section 301.25 (H)(I)a-d of the Waukee City code which outlines four (4)
criteria which must be met in order to grant a variance.
White stated that she had a problem with him meeting the provisions of Section 301.25 (H)(I)(b).
The Board addressed each section.
Motion by Schoeberl that the applicant meet the requirements of section 301.25 (H)(1)(a).Motion
failed for the lack of a second.
Motion by Schoeberl that the applicant met the provisions under Section 301.25 (H)(1)(c).Motion
No motion that the applicant met the requirements under Section 301.25 (H)(1)(b).

Motion failed for the lack of second,
Motion by Oxenford,second by Schoebcrl to dent the variance.Roll call was taken:Aye:Oxenford,
Schoeberl,White.Nays:None.Abstain:Mcf'oige.
The Board discussed at length the possibility of granting a request for a variance if the height of the
new garage was scaled back to seventeen (17)feet -the height of the current accessory structure.
The Board could not reach a consensus.Rueckel stated he would find out for certain if another
notice would be required if Mr.Cunningham desired to request a variance to build another 17 foot
structure or if it could be heard at the next meeting,
The Board discussed the minutes that were handed out regarding the Knaack Hearings.One of the
minutes had the incorrect date on it and another portion was missing.The Board stated that they had
never received the minutes from the Berg Hearing oflast year.These will be presented at the next
meeting,
Motion to adjourn at 7:30pm by Oxenford,Second by SchoeberL Motion passed 4-0.
