Roll Call.The Vice Chaitman asked for a roll call and the following Board Members were present:Phillips,Ellis,Drees.Absent:Colter,Oxenford.Others in attendance:Dennis Dowell, Ben Landhauser,Brad Deets,Dannette Cunningham,Pam Papenberg,Ron Sweeney. Approve the July 17,2009 Agenda.Motion by Board Member Phillips,seconded by Board Member Drees,to "Approve the agenda for July 17,2009."Ayes:Phillips,Drees,Ellis.Nays: None.Motion carried. Approve the April 9,2009 Board of Adjustment Minutes.Motion by Board Member Drees, seconded by Board Member Phillips,to "Approve the Apri19,2009 Board of Adjustment Minutes."Ayes:Drees,Phillips,Ellis.Nays:None.Motion carried. Application for 625 Ashworth Drive -Variance Request to allow for a 6 foot fence within a front yard.Vice Chairman Ellis asked if the City had received any correspondence.City Planner,Ben Landhauser noted that staff had not received any written correspondence,Vice Chairman Ellis briefly reviewed the application,submitted by Mark and Dannette Cunningham, property owners of 625 Ashworth Drive,with the Board.The property owners have two street frontages due to the irregular shape of their lot in relation to Ashworth Drive and 6th Street.The ] area of their property behind the house has approximately 83 feet of frontage to 6th Street,just north of Kenny's Pub.The applicants have applied for a permit to erect a 6 foot tall black vinyl fence surrounding the area behind their house and through the eastern boundary of the front yard adjacent to Ashworth Drive.Waukee City Code allows for fences placed in front yards,areas adjacent to public right-of-ways,to be 4 feet in height or less.Mrs.Cunningham explained to the Board that there have been issues with people leaving Kenny's Pub that wind up on their property which has caused some security concerns.The Board asked for clarification as to the specifics ofthe variance request.City Planner,Ben Landhauser,explained that the applicant was requesting a variance to place a 6 foot fence within the front yard,an 83 foot street frontage, adjacent to 6th Street and to allow a 6 foot fence to be placed within the front yard adjacent to Ashworth Drive,specifically along the eastern boundary ofthe property next to Kenny's Pub. Motion by Board Member Drees,seconded by Board Member Phillips to approve the variance request for 625 Ashworth Drive to allow a 6 foot fence to be place within the front yard adjacent to 6th Street and a 6 foot fence to be placed within the eastern boundary of the front yard adjacent to Ashworth Drive.Ayes:Drees,Phillips,Ellis.Nays:None.Motion approved.
