MINUTES OF THE July 29,2010 BOARD OF ADJUSTMENT MEETING Roll Call.The Chaitman asked for a roll call and the following Board Members were present:Oxenford,Morain,Phillips.Absent:Colter,Drees.Others in attendance:Ben Landhauser,Dennis Dowell,Alex Pfaltzgraff. Approve the July 29,2010 Agenda.Motion by Board Member Phillips,seconded by Board Member Morain to "Approve the agenda for July 29,2010."Ayes:Morain, Phillips,Oxenford.Nays:None.Motion carried. Approve the May 6,2010 Board of Adjustment Minutes.Motion by Board Member Phillips,seconded by Board Member Morain to "Approve the May 6,2010 Board of Adjustment Minutes."Ayes:Morain,Phillips,Oxenford.Nays:None.Motion carried. Application for 3232 Ashworth Road -Variance from Code Section 301.9(C.5)to allow for a deck to be placed within the 50 foot side yard setback of an agriculturally zoned property.Chairman Oxenford asked the Board ifthey were all familiar with the property and the request.The Board discussed the ownership of the property in relation to the property adjoining on the west side.Randy Leonard,tenant of 3232 Ashworth Road,noted to the Board that he had compiled a signed letter from the surrounding property owners who expressed support of the variance request.Benjamin Bascom Jr.,property owner of 3232 Ashworth Road,indicated that he was in full support of the tenant's desire to erect the deck around the existing pool.Chairman Oxenford requested clarification as to the future development anticipated for the property by the City's Comprehensive plan.City Planner Ben Landhauser explained that the comprehensive plan identifies the property as being a part of the Futures Corridor,which would direct any future redevelopment of the property into a commercial use or transitional use.The Board discussed the fact that the deck would be considered a temporary structure as the existing pool is above ground and not intended to be in use for the life ofthe property. Motion by Board Member Morain,seconded by Board Member Phillips "to Approve the Variance from Section 301.9 (C.S)for 3232 Ashworth Road to allow a deck to be erected around an existing pool at least 10 feet from the west property line."Ayes: Morain,Phillips,Oxenford.Nays:None.Motion approved. Old Business.None. New Business.None. Adjournment.Motion by Board Member Morain,seconded by Board Member Phillips, to adjourn at 5:37 p.m,Ayes:Morain,Phillips,Oxenford.Nays:None.Motion carried.
