The September 1,2005 Board of Adjustment meeting was called to order at 5:00 p.m.by
Chairman Oxenford.
Roll Call.The Chairman asked for a roll call and the following Board Members were present:
Lohstreter,Phillips,Oxenford.Absent:Colter,Ellis.Council Representative:Stanton.
Approve the September 1,2005 Agenda.Motion by Phillips,seconded by Lohstreter,to
"Approve the September 1,2005 Agenda."Ayes:Lohstreter,Phillips,Oxenford.Nays:None.
Motion carried.
Approve the May 26,2005 Board of Adjustment Minutes.Motion by Phillips,seconded by
Lohstreter,to "Approve the May 26,2005 Board of Adjustment Minutes."Ayes:Lohstreter,
Phillips,Oxenford.Nays:None.Motion carried.
Approve the Application of Southfork Homeowuers Association -Entry Monument Sign.
Wayne Goedken appeared before the Board on behalf of the Southfork Homeowners
Association.The Association has filed for a valiance from §305.3(E),which states that
monument signs are required to be placed a minimum of 15 feet from the public light-of-way in
an R-5 [Planned Unit Development]zoning district,The Association wishes to erect an entry
monument sign on the northwest corner ofSE University Ave.and SE Walnut Ridge Dr.The
sign would meet the setback requirement from SE University Ave.,but would only be 5 feet 1
from the SE Walnut Ridge Dr.right-of-way.Mark Arentsen addressed the Board,stating that J
the City Attomey advised the denial of the Valiance request,but that he personally disagreed
with that opinion.Mr.Arentsen explained that the zoning ordinance was currently under review
by the attorney IDd that changes could possibly be made to allow for special exceptions to the
ordinance where the Board may otherwise be unable to grant a variance.He stated that it would
be some time before such changes could go before the City Council for approval,and that due to
the weather-related construction restrictions associated with the current time of year,he
recommended approval of the variance.Mr.Arentsen also explained that the Public Works
Department had no conflicts with the proposed sign location.Chairman Oxenford asked if a
special exception would be approved for this project if the matter were tabled until the ordinance
was rewritten;Mr.Arentsen stated that it mayor may not.Board Member Lohstreter questioned
the intent of the setbacks;Dennis Dowen explained that it mostly concerned line-of-sight for
traffic and the safety issues surrounding that issue.There was some discussion regarding the
original Southfork entry monument sign.The Board was told that the original sign had been in
the public light-of-way but had been legally non-conforming.That sign was removed when the
University Ave.widening took place.Chairman Oxenford reviewed the criteria to be met in
order to gain approval for a variance;the Board concurred that as the original monument sign
had been removed by the City,special conditions occurred that were not a result of the
Association's actions.Motion by Lohstreter,seconded by Phillips,to "Approve the Application
of Southfork Homeowners Association -Entry Monument Sign."Chairman Oxenford asked for
a roll call vote.Ayes:Lohstreter,Phillips,Oxenford.Nays:None.Motion carried;variance II
approved.J
