Roll Call.The Chairman asked for a roll call and the following Board Members were present:Ellis, Oxenford,Phillips.Absent:Lohstreter,Colter.Others in attendance:Dennis Dowell,Shannon Lynch, Brad Deets and Council representative Mertz. Approve the October 16,2006 Agenda.Motion by Board Member Ellis,seconded by Board Member Phillips,to "Approve the October 16,2006 Agenda."Ayes:Ellis,Oxenford,Phillips.Nays: None.Motion carried. Approve the September 12,2006 Board of Adjustment Minutes.Motion by Board Member Ellis, seconded by Board Member Phillips,to "Approve the September 12,2006 Board of Adjustment Minutes."Ayes:Ellis,Oxenford.Phillips.Nays:None.Motion carried. Board member Colter joined the meeting via telephone at 5:35 p.m. Approve the Application for Waukee School District Baseball and Softball Complex -Building Setback Variance and Fence Height Variance.Chairman Oxenford asked Building Official Demus Dowell why the setback restrictions apply to this project when the code specifies these restrictions for a dwelling.Mr.Dowell explained the code also says "other permitted uses."City Planner Brad Deets explained that upon further reading,accessory structures are addressed in Section 301.8.Chairman Oxenford asked if there were any other questions or concems.Board member Ellis asked if the City I had heard from any of the neighbors.Mr.Deets said he had spoken with two neighbors,but they J' called with questions only,no objections.Board member Colter said the 25 ft fence tile school district was requesting approval of was a matter of safety for spectators.Chairman Oxenford asked if staff had any additional comments on the fence issue.Mr.Deets said the bleachers were to be placed seven feet from the property line and were a slight concem because of the public right-of-way and fU(UTe installation of a public bike trail.He explained further that the City had no substantial concems and they don't perceive any problems arising.Chairman Oxenford reviewed the criteria to be met in order to gain approval for a variance.Motion by Board Member Colter,seconded by Board Member Phillips,to "Approve the Application of Waukee School District Baseball and Softball Complex- Building Setback Variance and Fence Height Variance."Chairman Oxenford asked for a roll call vote. Ayes:Ellis,Coller,Phillips.Nays:None.Abstain:Oxenford.Motion carried;variance approved. Old Business.None. New Business.None.
