Roll Call.The Chairman asked for roll call vote and the following Board Members were present: Colter,Phillips,Oxenford.Absent:Ellis,GatreL Council Representative present:Gruber. Approve the November 13,2003 Agenda.Motion by Colter,seconded by Phillips,to "Approve the November 13,2003 Agenda."Ayes:Colter,Phillips,Oxenford.Nays:None.Motion carried. Approve the October 8,2002 Board of Adjustment Minutes.Motion by Colter,seconded by Phillips,to "Approve the October 8,2002 Board of Adjustment Minutes."Ayes:Colter,Phillips, Oxenford.Nays:None.Motion carried. Approve the Application of Ross Ladwig -25 SE Peachtree Dr.A variance is requested by Ross Ladwig,owner of property at 25 SE Peachtree Dr.,to build a gazebo within the front yard building setback on a corner lot.The structure surrounds a sunken hot tub,and had already been built without an approved building permit.Mr.Ladwig requests a variance from Waukee Municipal Code §301.8(D),which states "for corner lots platted or placed of record after December 29,1981,the front yard regulations shall apply to each street side of the corner lot."He also seeks a variance from §301.12(C)4,which states that front yards must rneasure 30 feet in an R-2 One and Two Family Residential District.Mr.Ladwig addressed the Board on his own behalf.Chairman Oxenford outlined the criteria to be met in order to gain approval for a variance.Chairman Oxenford also acknowledged that the Board has received letters from Bill and Angela Rose of 615 SE Redbud Ct.,and Jim and Ann Funk of 620 SE Redbud Ct.Both letters stated no objections to the structure,Matt Ward of 61 0 SE Redbud Ct.and Jasper Puccio of35 SE Peachtree Dr.addressed the Board and stated that they also had no objections to the structure.Motion by Colter,seconded by Phillips,to "Approve the Application of Ross Ladwig -25 SE Peachtree Dr."Chairman Oxenford asked for a roll call vote.Ayes:None. Nays:Colter,Phillips,Oxenford,Motion defeated. Old Business.None. New Busiuess.None.
