HomeMy WebLinkAbout2007-11-14-Board of Adjustment MinutesMINUTES OF THE NOVEMBER 14,2007 BOARD OF ADJUSTMENT MEETING The November 14,2007 Board of Adjustment meeting was called to order at 5:30 p.m.by Chairman Oxenford. Roll Call.The Chairman asked for a roll call and the following Board Members were present:Oxenford,Ellis, Lohstreter,Phillips.Absent:Colter.Others in attendance:Shannon Lynch,Brad Deets,Dennis Dowell,Ben Landhauser. Approve the November 14,2007 Agenda.Motion by Board Member Ellis,seconded by Board Member Phillips,to "Approve the agenda for November 14,2007."Ayes:Oxenford,Ellis,Lohstreter,Phillips.Nays:None.Motion carried. Approve the Jnne 14,2007 Board of Adjustment Minutes.Motion by Board Member Lohst:reter,seconded by Board Member Ellis,to "Approve the June 14,2007 Board of Adjustment Minutes."Ayes:Oxenford,Ellis, Lohstreter,Phillips.Nays:None.Motion carried. Approve the Application for Franco Real Estate Venture LLC,1125 SE Westbrooke Drive Side Yard Setback. Chairman Oxenford asked Director of Planning Brad Deets if the City had received any correspondence.Mr.Deets said nothing had been received either for or against granting the variance.City Planner Ben Landhauser provided background information on the property.Sue Stonehocker,representing Franco Real Estate,also addressed the Board.She stated that the original site plan for the property was designed so that an additional building could be constructed along the east property line in the future with the understanding that there were no side yard setback requirements because the property adjacent to the site was zoned for light industrial development.It was the property owner's intention,however,to maintain an eleven and one half foot setback along the east property line with the construction of the future building.In 2005,the property to the east was rezoned for residential uses.In doing so,it changed the side yard setback requirements on Stonehocker's property to a minimum of twenty-five feet instead of zero which was required at the time her property was purchased and the original buildings on the site were constructed.Discussion took place on the rezoning of the adjacent property and the effect it has on the subject property.Chairman Oxenford reviewed the criteria to be met in order to gain approval for a variance.Motion by Board Member Ellis,seconded by Board Member Lohstreter,to "Approve the Application of Franco Real Estate Venture LLC,1125 SE Westbrooke Drive Side Yard Setback based upon the hardship that has been placed upon the property was not self imposed and that the City created the hardship for the property owner when the adjacent property was rezoned for residential purposes."Chairman Oxenford asked for a roll call vote.Ayes:Oxenford, Ellis,Lohstreter,Phillips.Nays:None.Motion carried;variance approved. Old Business.None. New Business.None.
