MINUTES OF THE DECEMBER 27,2006 BOARD OF ADJUSTMENT MEETING
The December 27,2006 Board of Adjustment meeting was called to order at 5:28 p.m.by
Chairman Oxenford.
Roll Call.The Chairman asked for a roll call and the following Board Members were present:
Lohstreter,Ellis,Oxenford,Colter ..A..bsent:Phillips,Others in attendance:Shannon Lynch,
Brad Deets.
Approve the December 27,2006 Agenda.Motion by Board Member Ellis,seconded by Board
Member Colter,to "Approve the December 27,2006 Agenda."Ayes:Lohstreter,Ellis,
Oxenford,Colter.Nays:None.Motion carried.
Approve the October 16,2006 Board of Adjustment Minutes.Motion by Board Member
Colter,seconded by Board Member Lohstreter,to "Approve the October 16,2006 Board of
Adjustment Minutes."Ayes:Lohstreter,Ellis,Oxenford.Colter.Nays:None.Motion carried.
Approve the Application for Farm Bureau Financial Services -Building Sign Variance.
Chairman Oxenford asked if any correspondence was received by the City regarding this issue.
Director of Planning Brad Deets the City had not received any correspondence.Joe Phillips,
representing the sign company,and Tim Schillinger of Farm Bureau Financial Services
addressed the Board.Chairman Oxenford gave background information about the facelift done
at Liberty Park Mall.Mr.Schillinger explained that the old sign he had was 17 feet long by 3
feet wide.This sign was supposed to be reinstalled after completion of the facelift,but a "tower"
feature included in the facelift wouldn't accommodate the old sign.Mr.Schillinger explained
that Farm Bureau has certain required elements because of trademark issues and his landlord has
further restrictions on new signs installed on the building.Board member Lohstreter clarified
that the restrictions being placed upon the tenant are from the landlord,not the City.Board
member Colter expressed his concern that because the landlord and Farm Bureau were not
flexible,any flexibility would then fall to the City which would essentially mean our sign
ordinance would be govemed by corporations 81Idbureaucracy.Chairman Oxenford reasoned
that because Mr.Schillinger is a long time business owner in Waukee,the new sign will actually
be smaller than the old one,and he is replacing the sign through no fault of his own that the
Board should approve the variance.Board member Lohstreter maintained that this situation is
not due to a flaw in the ordinance but rather strict sign requirements of the landlord.Board
member Colter asked for clarification on what exactly the sign ordinance allows.Chairman
Oxenford reviewed the criteria to be met in order to gain approval for a variance,Motion by
Board Member Ellis,seconded by Board Member Colter,to "Approve the Application of Farm
Bureau Financial Services -Building Sign Variance."Chairman Oxenford asked for a roll call
vote.Ayes:Ellis,Colter,Oxenford.Nays:Lohstreter.Motion carried;variance approved.
New Business.Chau1n811Oxenford asked about Board member Ellis'reappointment to the
Board of Adjustments since his term expires on December 31,2006.City Planner Deets said all
appointments belong exclusively to Mayor Peard and he will be announcing his appointments at
the January 8,2007 City Council meeting.
