Chairman September 29,1986 The meeting of the Board of Adjustment was called to order at 7:10 porno by Chairman,Al Griero Members present were Grier,Storey,and Slaughtero Guests present were Bob Sayre,Harold Bissell,Mark Gruber and Brian Redshaw. This meeting was to consider the appeal of Bobby L Sayreo Mr Sayre requests a variance to construction a 16'X 20'deck on the rear of his house at 135 Waukee,with a walk-way to his east entrance 0 Section 301.7 of the Waukee Municipal Code clearly states that it is the intent of the zoning ordinance to permit non-conformities to continue until they are removed,but not to encourage their survival.Since the garage is located closer than the required 10 foot set-back,this porperty is considered a non-conforming use. Section 30108 of the Waukee Municipal Code state that no unenclosed balcony or unenclosed porch shall be constructed closer than 3 feet to an accessory building.The applicant wishes to construction a deck 2 feet away from his garage.
