RESOLUTION 14-111
APPROVING THE FIRST AMENDMENT TO ELECTRIC TRANSMISSION LINE
EASEMENT BETWEEN MIDAMERICAN ENERGY COMPANY,GILCREST JEWETT
LUMBER COMPANY AND THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE,IOWA
WHEREAS,the City of Waukee,Dallas County,State ofIowa,is a duly organized Municipal
Organization;AND,
WHEREAS,on June 24,2013,the Waukee City Council approved a reimbursement agreement
with MidAmerican Energy Company related to the relocation of electrical poles as part ofthe
Alice's RoadfUniversity Avenue Intersection Improvements Project (Resolution #13-163);AND
WHEREAS,MidAmerican Energy Company has since discovered the need for an additional
electrical transmission line to be located on property owned by Gilcrest Jewett Lumber
Company;AND,
WHEREAS,the proposed electrical transmission line is located within an existing storm sewer
easement which must be amended by both Gilcrest Jewett Lumber Company and the City of
Waukee;AND,
WHEREAS,Gilcrest Jewett Lumber Company agrees to the easement and has submitted to the
City of Waukee a signed First Amendment to Electrical Transmission Line Easement;
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee,Iowa
on this 5th day of May,2014,that the First Amendment to Electrical Transmission Line
Easement,attached hereto as Exhibit A,be and the same is hereby accepted and approved by the
City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to file the
First Amendment to Electrical Transmission Line Easement,as well as any other documents
related thereto,with the Dallas County Recorder.
