HomeMy WebLinkAbout2020-01-20-I01L Zoning Extension - University Woods AGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: January 20, 2020 AGENDA ITEM: Consideration of approval of a resolution approving extension of zoning regarding certain Planned Unit Development provisions (University Woods) FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The property located at 15705 SE University Avenue which is generally located on the north side of University Avenue and east of The Winhall Apartments was subject to a rezoning of the property that was approved in August 2017. The approved rezoning allowed for the use of the property as a senior living development as well as a skilled recovery center as had previously been approved for the property. The Planned Development document included a provision related to the commencement of the project and specifically stated that if construction of the project had not commenced by January 1, 2019, then the City Council would have the option to rezone the property back to the previous zoning of the property that was completed in 2012. This would require the City Council follow the same process as it does for any rezoning applications including a review of the zoning change by the Planning and Zoning Commission and a public hearing before the City Council. The provision also stipulated that the property owner had the option to request an extension of the zoning approved in 2017 for one year increments. The City Council approved the extension last January and the owner is again requesting a year extension of the zoning provisions approved in 2017 to January 1, 2021. FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: Staff would recommend approval of the extension request. Request from Property Owner PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: THE CITY OF WAUKEE, IOWA RESOLUTION 2020- APPROVING THE REQUEST FOR EXTENSION OF ZONING RELATED TO UNIVERSITY WOODS -15705 SE UNIVERSITY AVENUE IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal Organization; AND, WHEREAS, UNIVERSITY WOODS LLC, is the owner of certain property located at 15705 University Avenue (Parcel # 1235300005) (the “Property”); AND, WHEREAS, the City Council approved certain zoning on the property on August 7, 2017 recorded in Book 2018 at Page 3148 (the “Planned Development”) which allowed for the development of a senior living project or a skilled recovery center; AND, WHEREAS, the Planned Development included certain language that would allow the City Council to rezone the Property back to the pre-existing zoning and overlay requirements as recorded in Book 2012, Page 23457 if construction had not commenced by January 1, 2019; AND, WHEREAS, the Planned Development included language that allowed the Property Owner to request one-year extensions extending the zoning provisions to January 1, 2020; AND, WHEREAS, the City Council approved at one year extension extending the zoning provisions to January 1, 2020 on January 7, 2019; AND, WHEREAS, the City has received a request from the Property Owner requesting an additional one- year extension of the current zoning provisions as recorded in Book 2018 Page 3148 to January 1, 2021. The City has approved entitlements for a Senior Living Residential Community in Ordinance No. 2854, passed August 7, 2017. Pursuant to paragraph 7 in the Ordinance, we respectfully request a one-year extension of the approved site plan and start-up date from January 1, 2020 – December 31, 2020.
