January 20, 2020
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman, R. Charles Bottenberg, Chris Crone, Larry R. Lyon. Absent: None.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Human
Resource Director Michelle Lindsay, Public Works Director/City Engineer Rudy Koester,
Development Services Director Brad Deets, Community & Economic Development Director Dan
Dutcher, Parks & Recreation Director Matt Jermier, Marketing & Communications Director
Summer Evans, IT Director Son Le, Police Chief John Quinn, City Clerk Rebecca D. Schuett,
City Attorney Pat Burk.

(E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council
Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon. Nays: None.
Motion carried 4 – 0.
(F) Presentations:
1) Iowa League of Cities 2020 legislative priorities – Presentation made by Daniel Stalder,
Government Affairs Outreach Coordinator for the Iowa League of Cities.
(G) Public Hearings:
1) On an ordinance to amend Chapter 165, Zoning Regulations, Administration and
Enforcement, Waukee, Iowa by revising provisions for Urban Chickens – Mayor Clarke
opened the public hearing and asked if any written correspondence had been received; City
Clerk Schuett replied in the negative. Development Services Director Deets briefly reviewed
the proposed ordinance, which revises the maximum number of chickens allowed based on
lot size or acreage, with an absolute maximum of 30 chickens allowed. No comments were
made by the public in attendance.
2) On a proposal to enter into a Development Agreement with Waukee Crossing, LLC –
Mayor Clarke opened the public hearing and asked if any written correspondence had been
received; City Clerk Schuett replied in the negative. Community & Economic Development
Director Dutcher briefly reviewed the proposed agreement, which addresses the City’s
reimbursement of the developer for various public street improvements. No comments were
made by the public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 165, Zoning
Regulations, Administration and Enforcement, Waukee, Iowa by revising provisions
for Urban Chickens [introduction; first reading] – Council Member Bottenberg introduced
the ordinance and moved to approve the first reading in title only; seconded by Council
Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon. Nays: None.
Motion carried 4 – 0.
2) Resolution: Consideration of approval of a resolution approving and authorizing
execution of a Development Agreement by and between the City of Waukee and
Waukee Crossing, LLC – Council Member Lyon moved to approve the resolution;
seconded by Council Member Bergman. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon. Nays: None. Motion carried 4 – 0. (Resolution #2020-026)

1) Consent Agenda: Council Member Bottenberg moved to approve the Consent Agenda;
seconded by Council Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone,

reading in title only, waive the second and third readings, and place the ordinance on final

explained that the proposed ordinance would move the rates to the fee schedule annually

6) Resolution:Consideration of approval of a resolution approving preliminary plat for
Vince Meyer Learning Center Plat 1 – Council Member Lyon moved to approve the
resolution; seconded by Council Member Crone. Development Services Director Deets
reviewed both the preliminary plat and site plan. He gave a brief history of the original
structure, additions and demolition of additions. The proposed plat is for a new addition to
house the district’s preschool students. There is a second addition on the west side of the
original structure that will house the district’s IT department. Pick-up and drop-off will be on
the north side of the building, with a designated 4th St. drop-off for special needs students
only. Mr. Deets then reviewed the onsite detention and building exterior elevations. Results
of vote: Ayes: Bergman, Bottenberg, Crone, Lyon. Nays: None. Motion carried 4 – 0.

10) Resolution:Consideration of approval of a resolution approving Agreement for
Professional Consulting Services with Foth Infrastructure and Environment, LLC [SE
Ashworth Road Corridor Improvements, 1800 Feet West of Grand Prairie Parkway to
Waco Place] – Council Member Bottenberg moved to approve the resolution; seconded by
Council Member Lyon. Public Works Director/City Engineer Koester reviewed the proposed
corridor improvements project, including design fees and total construction costs. Mayor
Clarke asked about the timing of the project; Mr. Koester replied that design would take

place in 2020 with an anticipated 2021 construction in order to align with the City of West
Des Moines’ timeline for Ashworth Rd./I-80 overpass improvements. City Administrator
Moerman noted that Waukee’s Ashworth Rd. project was not currently included in the
Capital Improvement Plan but that City staff will know by the time for bid letting if it can be
funded. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon. Nays: None. Motion

A. Call to Order – The work session meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:32 p.m. at Waukee City Hall, 230 W. Hickman Rd.
B. Roll Call – The following members were present: Mayor Courtney Clarke; Council Members R. Charles
Bottenberg, Chris Crone, Larry R. Lyon. Absent: Council Member Anna Bergman. (Council Member
Bergman arrived at 5:37 p.m.)

D. Work Session:

1) Budget approval timeline – Due to a possible lack of a quorum, the council agreed to reschedule
the March 16 regular meeting to March 23. (Council Member Bergman arrived at 5:37 p.m.)
2) FY2021 Budget: General, Enterprise Funds – Jon Burmeister and Matt Stoffel with Public
Financial Management (PFM) discussed utility funds, recommending increases in water, sewer
and stormwater rates. City Administrator Moerman and Finance Director Burkhart reviewed the
proposed general fund and capital equipment recommendations. The council discussed FY2021
contributions.
E. Comments – Police Chief Quinn updated the council on an ongoing investigation. City Clerk Schuett
distributed the proposed meeting format for the February 4 interviews of applicants for the council
vacancy.
