MEETING DATE: March 23, 2020
AGENDA ITEM:Consideration of approval of a resolution approving a memorandum of
understanding with Communications Workers of America (CWA), Local
#7102, AFL-CIO, as part of the July 1, 2016 – June 30, 2021 contract adding
a temporary use of sick leave policy [addition of a Temporary use of sick
leave policy to the existing employee sick leave benefit]

SYNOPSIS INCLUDING PRO & CON: At the March 23rd Council meeting, a resolution was
approved to add a temporary use of sick leave policy, modifying the allowable
use of sick leave for full-time employees and allowing part time employees to
be compensated up to two (2) weeks of paid leave due to the impact of Covid-
19. Due to this action, a memorandum of understanding is needed to amend
the July 1, 2016 – June 30, 2021 contract to include those employees covered
by the current union contract.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: This temporary policy is
intended to protect the safety of the workforce and address the physical and financial well-
being of those employees personally affected by the coronavirus, Covid-19, pandemic and is
not expected to have any financial impact as all personnel costs have been previously
accounted for through the budget process.
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff recommends approval of the resolution approving the
memorandum of understating.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2020-
APPROVING A MEMORANDUM OF UNDERSTANDING WITH COMMUNICATIONS
WORKERS OF AMERICA (CWA), LOCAL #7102, AFL-CIO, AS PART OF THE JULY 1,
2016 – JUNE 30, 2021 CONTRACT
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on May 23, 2016, the Waukee City Council approved a Collective Bargaining
Agreement with the Communications Workers of America (CWA), Local #7102, AFL-CIO, in effect
July 1, 2016 through June 30, 2021 (Resolution #16-219); AND,
WHEREAS, the City of Waukee and representatives of CWA, Local #7102, have reviewed and
approve a Memorandum of Understanding which modifies the allowable use of sick leave for full-time
employees; AND
WHEREAS, allows part time employees, working a consistent schedule averaging 20 hours per week,
or more, on a year round basis to be compensated up to two (2)weeks of paid leave for the purpose of
a quarantine, personal illness, or to care for a family member with illness attributed to Covid-19; AND
WHEREAS, the Memorandum of Understanding is attached hereto and by reference incorporated
herein;
NOW THEREFORE BE IT RESOLVED by the City of Waukee City Council in session this 23rd
day of March 2020, that the Memorandum of Understanding with Communications Workers of
America (CWA), Local #7102, AFL-CIO, as part of the July 1, 2016 – June 30, 2021 contract, is
hereby approved.

TEMPORARY POLICY ON USE OF SICK LEAVE DURING COVID-19 RESPONSE
This temporary policy is intended to protect the safety of the workforce and address the
physical and financial well-being of those employees personally affected by the coronavirus,
Covid-19, pandemic.
1.All full-time employees may borrow against future sick leave accruals up to four (4) weeks,
once their current sick leave balance is exhausted, for the purpose of a quarantine,
personal illness, or to care for a family member with illness attributed to Covid-19.
2.Full time employees with children who use daycare services are eligible to use up to four
(4) weeks of sick leave to care for a child who is in daycare, or before and/or after school
care, and whose daycare services are no longer available due to the impact of Covid-19.
3.All part-time employees, working a consistent schedule averaging 20 hours per week, or
more, on a year round basis will be compensated up to two (2) weeks of paid leave, for
the purpose of a quarantine, personal illness, or to care for a family member with illness
attributed to Covid-19.
4.In the event of an occupational exposure to Covid -19, during the pandemic, by a Paid-on-
Call employee resulting in a partial or full quarantine or isolation, the Paid-on-Call
employee will be compensated for any shift in which they were originally assigned.
For the purpose of determining compensation for #3 & #4, pre-assigned or scheduled
hours/shifts will be used in calculating paid weeks of leave. In the absence of previously
scheduled hours/shifts, an average number of hours/shifts during a pay period will be used to
determine compensation.
