CITY COUNCIL MEETING COMMUNICATION

AGENDA ITEM:Consideration of approval of a Motion to set a Public Hearing Date of
April 6, 2020, as the date of public hearing concerning the vacation and
disposal of a street or alley pursuant to Iowa Code Sections 354.23,
364.12(2)(A) and 364.7 (2020) [Elm Street]
FORMAT:Motion
SYNOPSIS INCLUDING PRO & CON: City staff has been approached by an adjoining
property owner regarding a small portion of existing right way at the
west end of Elm Street located west of 6th Street. The right of way is
unimproved and dead ends to the former railroad right of way.
The City Council was initially schedule to hold the public hearing on this
matter at the March 23, 2020 regular meeting. However, due to a change
of plans for that meeting to be held electronically only due to public
health concerns, the public hearing must be rescheduled and notice
republished in accordance with the Code of Iowa.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT:
STAFF REVIEW AND COMMENT: Staff would recommend a public hearing date be set for
April 6, 2020, to consider any proposals from adjoining property owners
for the acquisition of the right of way in question.
RECOMMENDATION: Approve the motion.
