AGENDA ITEM:Consideration of approval of a resolution approving Professional Services
Agreement Amendment #1 with Confluence for the Triumph Park Project in
the amount of $307,380.00.
FORMAT:Resolution
SYNOPSIS INCLUDING PRO & CON: The original contract was approved by the City Council in
2017 and did not include design services for the baseball pod. At the time it
was presented that when the baseball pod was added that an amendment to the
contract would be proposed. Professional Services Agreement Amendment
#1 includes the following Scope of Services:
1.All work associated with completing the construction for the baseball
quad to the SE of the current complex. (Excluding Civil).
2.Structural design of the wall associated with the EPIC playground.
3.Lighting coordination with Landscape Structures to include lights
within the EPIC Playground.
4.Lighting coordination to include the lighting of the Fishing Pier.
5.Addition of a Cost Estimating consultant to review 90% DD
Drawings as well as 50% CD Drawings to confirm budget.
6.Limited Civil Engineering to complete what was not part of School
scope.
7.Additional Restroom Facility near the Miracle Field and Epic
Playground.
8.Maintenance Building Design
9.Bridge Design across the pond.
10.Miracle Field Lighting Layout.
Original Contract: $586,000
Supplemental Contract #1: $307,380
Total: $893,380 (4.5% of the overall budget)
The current contract does not include Construction Administration. As we get
closer to construction we can anticipate Supplemental Contract #2. Today’s
estimate of Supplemental Contract #2 is $195,000.

WITH CONFLUENCE [TRIUMPH PARK, FORMERLY KNOWN AS WAUKEE
YOUTH SPORTS COMPLEX]
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, on February 20, 2018, the Waukee City Council approved an Agreement for
Professional Consulting Services with Confluence, Inc., for design services related to the
Waukee Youth Sports Complex (Resolution #18-076); AND,
WHEREAS, the Waukee Youth Sports Complex has since been renamed as Triumph Park;
AND,
WHEREAS, the City recommends approval of a Professional Services Supplemental Agreement
No. 1 with Confluence for additional work;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee that the
Professional Services Supplemental Agreement No. 1 with Confluence [Triumph Park, formerly
known as Waukee Youth Sports Complex] is hereby approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 20th day of April,
2020.

Supplemental Services Agreement # 1
Dear Tim,
In meeting with the Parks and Recreation Department over the last few months we have been progressing toward the completion of construction documents
for Triumph Park. At a recent meeting it was discussed that we would be adding the Baseball fields to the Southeast back into the scope of work for this
project. This is fantastic news and it will certainly add to the impact this project makes on the community. Back in 2017 we had originally included this
scope in our work as an alternate that was just under 260K to complete. Somewhere in the process we were asked to remove that and process with just the
scope north of the ponds. This supplemental contract will be to add this scope back into the contract as well as a few additional items outlined below.
Additional Scope Items included in the Supplemental agreement:
1. All work associated with completing the construction documents for the baseball quad to the SE of the current complex. (excluding Civil)
2. Structural design of the wall associated with the EPIC playground
3. Lighting coordination with Landscape Structures to include lights within the EPIC Playground
4. Lighting coordination to include the lighting of the Fishing Pier. (Coordination with Ethos Architects)
5. Addition of a Cost Estimating consultant to review 90% DD Drawings as well as 50% CD Drawings to confirm budget
6. Limited Civil Engineering to complete what was not part of the School scope.
7. Architecture and MEP for Additional Restroom facility near the Miracle Field.
8. Revised Architectural and MEP for expanded scope at the Maintenance Building
9. Structural design of bridge crossing the pond
10. Miracle field lighting design
Total Contract Adjustment requested: $307,380 (Confluence and consultants honored previously supplied numbers. Main fee increase was from the
original $260k was for the cost consultant and limited Civil Engineering is now included.)

ATTACHMENT “A” - SCOPE OF SERVICES

The work to be performed by the Consultant under this agreement shall encompass and include all detail
work, services, materials, equipment and supplies necessary for the project planning development. The
project consists of engineering services for a Triumph Park in Waukee, Iowa. This scope of services is
based on the following project assumptions:
Design is based off the final approved building layout from February 25, 2020, any revisions to
the approved layout will result in additional services.
Sheeting for Bid Package shall include utilities only.
Design Utility Service Connections for three concession buildings, one bathroom, and one
maintenance building.
o 4” sanitary sewer service for all buildings
o 4” water service for concession buildings
o 6” water service for maintenance building
o 2 ½” water service for miracle field bathroom building
8” water main loop with corresponding hydrants and valves across the park to ensure water
continuous connection.
Design of Parking lot storm sewer per Confluence Grading Plan with corresponding outlet
protection.
Design of subsurface drainage for water quality basins/swales.
Coordination of cross connection of irrigation systems to water main.
The scope of services to be performed by the Consultant shall be completed in accordance with generally
accepted standards of practice and shall include the services to complete the following tasks:
Basic Services of the Engineer:
Task A – Site Design Services
1.0 CONTRACT MANAGEMENT
1.1 Project Management
The project manager will be responsible for the development and tracking of the project plan for the
project development. This includes task identification, staff scheduling and coordination, project
communications, monthly progress reporting and invoicing and other important elements of the project.
The project duration is assumed to be five (5) months.
1.2 Project Review Meetings.
Maintain communications with the project development team and various other designated
representatives. The project development team will include City of Waukee, Confluence, Ethos Design
Group, Inc., KCL Engineering and Foth. Meet to review progress and to discuss specific elements of the
project design. The meetings will also serve to establish schedules, develop project goals, establish
initial design parameters, promote a dialog between the various entities, improve the decision-making
process, expedite design development and identify potential funding opportunities. For budget purposes,
it is assumed five (5) meetings will be attended by one (1) staff members of the Consultant.
1.3 Site Development Utility Coordination
The Consultant will contact representative of various utility companies to address specific project
development plans with the site. The discussions will be to advise of the nature and extent of the
improvements and any potential conflicts with existing or proposed utility systems, and discuss project
design including specific project coordination. The utility services to be coordinated shall include: water,
gas, electric and telephone.

1.4 Quality Control Review
Involve ongoing quality control input from the Project Team and the design engineer’s senior technical
staff throughout the development of preliminary plans and documents for each project segment. The
design engineer is responsible for making specific recommendations and ensuring that critical issues are
discussed and resolved prior to submittal of the preliminary plan set to the Project Team.
Review the site development plan set for technical accuracy, as well as for general constructability and
conformance with the project design criteria.
2.0 CONCEPTUAL DESIGN DEVELOPMENT – Task Not Included.
3.0 PRELIMINARY DESIGN DEVELOPMENT – Task Not Included.
4.0 FINAL CONSTRUCTION PLANS
Following the completion of preliminary design development the Consultant shall subsequently proceed
with final design, construction contract drawings, special provisions, and estimates for the proposed
improvements. The work tasks to be performed by the Consultant under Final Construction Plans shall
include the following:
4.1 Incorporate Comments from Preliminary Design Review
The Consultant will respond to comments resulting from the preliminary plan review. Recommended
modifications will be incorporated into the plan set.
4.2 Final Design and Plan Preparation (Bid Package)
Upon approval preliminary plans, the Consultant will prepare final plans, which will generally include
development of final design details and plan preparation for the following tasks: storm sewer systems,
sanitary sewer systems, and water systems.
5.0 PROJECT BIDDING SERVICES
The Construction Manager (CM) Story Construction shall coordinate and manage the bid process for the
project. This will involve coordination of multiple project bids for the various stages of project
construction. The work tasks to be performed or coordinated by the Consultant shall include the
following:
5.1 Printing of Plans and Specifications – Task Not Included.
5.2 Notice of Project – Task Not Included.
5.3 Plan Clarification and Addenda
The bid process shall be administered by the CM. The Consultant shall assist the CM during the bid
period in answering questions regarding the design intent. The Consultant shall prepare addenda as
appropriate to interpret, clarify or expand the bidding documents. It is anticipated that the CM will
distribute the plan clarification information and addenda to the project plan holders.
5.4 Letting, Bid Tabs, and Award Recommendation
The Consultant shall be a representative present when the bids and proposals are opened and shall
advise the Owner on the responsiveness of the bidders. The CM shall prepare a tabulation of bids,
award the contract and prepare the necessary contract documents for the project.

PROJECT DELIVERABLES
The scope of services shall be considered complete upon completion and delivery of the following items
to the satisfaction of Confluence:
1.) One (1) set of the original construction drawings and specifications.

2.) Design Surveys (control, topographic, utility, legal boundary and plat of survey)

7.) Architectural Design of Building Structures.
8.) Site Lighting and Electrical Design
9.) Site Telecommunications Design
10.) Water System Flow/Pressure Testing.
11.) Annexation & Urban Renewal Documentation.
12.) Right-of-way Negotiation and Acquisitions.
13.) Environmental Services and Documentation.
14.) Cultural Resource Evaluation.
15.) Report of record ownership and liens (title searches).
16.) Design public hearing.
17.) Eminent domain proceedings.
18.) Relocation assistance.
19.) Right-of-way closing/recording services.
20.) Condemnation services.
21.) Resident Construction Engineering/Observation.
22.) Construction Survey.

If notice to proceed is given at a later date, time of completion shall be extended accordingly.
