April 20, 2020
*Due to public health concerns and guidance, in accordance with Iowa Code Sections
21.4(1)(b) and 21.8, this meeting of the Waukee City Council was conducted electronically as
holding the meeting in person was impossible or impractical.
(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom
pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8.
(B) Pledge of Allegiance (temporarily suspended)
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R.
Lyon (electronically), Ben Sinclair (electronically). Absent: None.
Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Public
Works Director/City Engineer Rudy Koester, Development Services Director Brad Deets, Parks
& Recreation Director Matt Jermier, IT Director Son Le, Police Chief John Quinn, Fire Chief Clint
Robinson (electronically), Marketing & Communications Director Summer Evans (electronically),
Human Resource Director Michelle Lindsay (electronically), City Clerk Rebecca D. Schuett, City
Attorney Steve Brick (electronically).

(E) Agenda Approval – Council Member Crone moved to approve the agenda; seconded by
Council Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 – 0.

(G) Action Items Prior to Public Hearings:
1) Resolution: Consideration of approval of a resolution ratifying, confirming and
approving publication of Notice of Public Hearing [Not to exceed $1,000,000 Sewer
Revenue Capital Loan Notes]– Council Member Lyon moved to approve the resolution;
seconded by Council Member Crone. City Clerk Schuett stated that the notice was
published prior to approval by council; the proposed resolution retroactively approves the
publication. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 – 0. (Resolution #2020-132)
(H) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, Iowa, by
rezoning certain property from C-4, C-1 and R-3 to K-RC, K-OF, K-MF Stacked Medium,
and K-MF Stacked High, a property known as the Giles Property – Mayor Clarke opened
the public hearing and asked if any written correspondence had been received; City Clerk
Schuett replied in the negative. Development Services Director Deets briefly reviewed the
rezoning application for approximately 38 acres. He reviewed a development concept plan,
which includes the extensions of SE Pleasant View Dr. and SE Prairie Park Ln. The
development will include stormwater detention that will serve a larger area. The rezoning
request is in general conformance with the Kettlestone Master Plan. Mike Gaunt with Bishop
Engineering, representing the applicant, introduced himself and offered to answer any
questions about the application. Council Member Bottenberg asked if the westerly detention
pond would be constructed with this development or as part of a future phase; Mr. Deets
replied that the applicant was in conversation with the Giles family regarding the early
installation of the pond and that the matter would need to be resolved before the platting
process. No comments were made by the public in attendance.
2) On the annexation of consenting properties [Graham Property] – Mayor Clarke opened
the public hearing and asked if any written correspondence had been received; City Clerk

Schuett replied in the negative. Development Services Director Deets briefly reviewed the
annexation application for a property on the east side of NW 10th St., just north of the
Northwest High School/Triumph Park site. No comments were made by the public in
attendance.
3) On the annexation of consenting properties [Petersen/Moore/Stratford Crossing
Property] – Mayor Clarke opened the public hearing and asked if any written
correspondence had been received; City Clerk Schuett replied in the negative. Development
Services Director Deets briefly reviewed the annexation application for properties on the
west side of NW 10th St., just west of Triumph Park. No comments were made by the public
in attendance.
4) On plans, specifications, form of contract and estimate of cost [Alice’s Road
Landscape Enhancements Project] – Mayor Clarke opened the public hearing and asked
if any written correspondence had been received; City Clerk Schuett replied in the negative.
Development Services Director Deets briefly reviewed the project, including certain
amenities included in the enhancements. Council Member Lyon recalled the council having
concerns with the project earlier in the process but could not recall those concerns; Mr.
Deets answered that the previous concerns were with overall project costs, adding that the
project costs were successfully reduced since that conversation. No comments were made
by the public in attendance.
5) On plans, specifications, form of contract and estimate of cost [Waukee Public Library
Stormwater Improvements Project] – Mayor Clarke opened the public hearing and asked
if any written correspondence had been received; City Clerk Schuett replied in the negative.
Public Works Director/City Engineer Koester briefly reviewed the project. He also reviewed
the various funding sources for the project, including SRF funds, an Iowa Department of
Agriculture and Land Stewardship grant, GO bonds, savings from the Alice’s Road
Landscape Enhancements Project, and the stormwater utility fund. No comments were
made by the public in attendance.
6) On the authorization of a Loan and Disbursement Agreement and the issuance of
Notes to evidence the obligation of the City thereunder [Not to exceed $1,000,000
Sewer Revenue Capital Loan Notes] – Mayor Clarke opened the public hearing and asked
if any written correspondence had been received; City Clerk Schuett replied in the negative.
Public Works Director/City Engineer Koester briefly reviewed the issuance, noting that the
action would allow for the amendment of a previously authorized loan agreement. The City
would take part of the interest on that original loan and apply it to the Waukee Public Library
Stormwater Improvements Project. The principal payment on the loan would not be
adjusted. City staff anticipates the actual cost to be nearer $920,000 and not the full
$1,000,000. No comments were made by the public in attendance.
(I) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by rezoning certain property from C-4, C-1 and R-3
to K-RC, K-OF, K-MF Stacked Medium, and K-MF Stacked High, a property known as
the Giles Property [introduction; first reading] – Council Member Lyon introduced the
ordinance and moved to approve the first reading in title only; seconded by Council Member
Bottenberg. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 – 0.
2) Resolution: Consideration of approval of a resolution approving annexation of
consenting properties by the City of Waukee, Iowa [Graham Property]– Council
Member Crone moved to approve the resolution; seconded by Council Member Lyon.
Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion
carried 5 – 0. (Resolution #2020-133)
3) Resolution: Consideration of approval of a resolution approving annexation of

4) Alice’s Road Landscape Enhancements Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Crone
moved to approve the resolution; seconded by Council Member Lyon. Results of vote:
Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Lyon moved to approve the resolution; seconded by Council Member Crone.
Development Services Director Deets reviewed the bid tabulation and engineer’s
estimate, recommending award to Koester Construction Co., Inc., of Grimes, IA, in the
amount of $465,700.00. Council Member Lyon asked if staff was confident that the
project requirements were interpreted correctly by bidders; Mr. Deets replied in the
affirmative. Mr. Deets then added that Koester would likely have subcontractors for the
signage and landscaping portions of the project. Council Member Sinclair asked if the
project had any substantial changes since the last council review; Mr. Deets replied that
there were no substantial changes but that the engineer’s estimate was lowered as the
project was further refined. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon,
Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-136) The contract was
awarded to Koester Construction Co., Inc., of Grimes, IA.
5) Waukee Public Library Stormwater Improvements Project
A. Resolution: Consideration of approval of a resolution approving plans,
specifications, form of contract and estimate of cost – Council Member Lyon moved
to approve the resolution; seconded by Council Member Sinclair. Results of vote: Ayes:
Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

B. Resolution: Consideration of approval of a resolution awarding contract – Council
Member Crone moved to approve the resolution; seconded by Council Member Lyon.
Public Works Director/City Engineer Koester reviewed the bid tabulation and engineer’s
estimate, recommending award to Elder Corporation of Des Moines, IA, in the amount of
$2,162,580.00. Council Member Crone asked about how the City solicits bids; Mr.
Koester briefly reviewed the process. Results of vote: Ayes: Bergman, Bottenberg,
Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-138) The
contract was awarded to Elder Corporation of Des Moines, IA.
6) Sewer Revenue Capital Loan Notes
A. Resolution: Consideration of approval of a resolution instituting proceedings to
take additional action [Not to exceed $1,000,000 Sewer Revenue Capital Loan
Notes] – Council Member Crone moved to approve the resolution; seconded by Council
Member Lyon. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.
Nays: None. Motion carried 5 – 0. (Resolution #2020-139)
B. Resolution: Consideration of approval of a resolution amending the original
resolution, approved on August 7, 2017 (Approving and Authorizing a Loan and
Disbursement Agreement with the Iowa Finance Authority and Authorizing and
Providing for the Issuance of Sewer Revenue Capital Loan Notes, Series 2017) in
order to provide for the funding of a sponsored project under the terms of a new
Series 2017 Note to be issued in the principal amount of $10,523,374.71, which
includes approval of a Supplemental Tax Exemption Certificate – Council Member
Sinclair moved to approve the resolution; seconded by Council Member Crone. Public
Works Director/City Engineer Koester and Finance Director Burkhart reviewed the note
amendment. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays:
None. Motion carried 5 – 0. (Resolution #2020-140)

2) Ordinance:Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, Iowa, by amending Chapter 169.01, Establishment of
Districts; Provisions for Official Zoning Map, by repealing said section and enacting in
lieu thereof the readoption of the Official Zoning Map [second reading] – Council
Member Crone moved to approve the second reading of the ordinance in title only;
seconded by Council Member Sinclair. Results of vote: Ayes: Bergman, Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Motion carried 5 – 0.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 203, Waukee
Municipal Code, by repealing the existing rates for water and enacting new rates as
specified [introduction; first, second, third (final) readings] – Council Member Lyon
introduced the ordinance, moved to approve the first reading in title only, waive the second
and third readings, and place the ordinance on final passage; seconded by Council Member
Crone. Public Works Director/City Engineer Koester stated that an error was discovered
during approval of the second reading of the ordinance. The error has been corrected,
requiring the ordinance to go through all three readings again. Results of vote: Ayes:
Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Ordinance

noting that it would be developed with common parking for all four lots. Stormwater
management would be addressed through two onsite ponds. Results of vote: Ayes:

7) Resolution: Consideration of approval of a resolution approving final plat for Stone

Council Member Crone. Development Services Director Deets reviewed the plat, noting a
planned landscape buffer where the plat abuts residential development. Results of vote:

8) Resolution: Consideration of approval of a resolution approving site plan for Stone
Prairie Plat 7 Phase 1 [2155 SE L.A. Grant Parkway] – Council Member Sinclair moved to
approve the resolution; seconded by Council Member Crone. Development Services
Director Deets reviewed the site plan for a medical office building. The property owner to the
west expressed concerns with stormwater outflow from the site; those concerns will be
addressed through the dispersal of water over a larger area. Mr. Deets then reviewed
exterior elevations. Mayor Clarke asked if the building signage would face SE L.A. Grant
Pkwy.; Mr. Deets replied in the affirmative. Council Member Lyon noted that the exterior
elevations were very similar to many other site plans recently approved by council and asked
if such a look would be dated in some years; Mr. Deets answered that staff’s overall focus is
on building design and durable material use and that future upkeep and updates should be
expected with all buildings as they age. Results of vote: Ayes: Bergman, Bottenberg, Crone,
Lyon, Sinclair. Nays: None. Motion carried 5 – 0. (Resolution #2020-153)
9) Resolution: Consideration of approval of a resolution approving preliminary plat for
Stratford Crossing Flats – Council Member Lyon moved to approve the resolution;
seconded by Council Member Crone. Development Services Director Deets reviewed the
preliminary plat, final plat and site plan at this time. He noted that the property was zoned as
R-3 (Multi-Family Residential District), but that the proposed development would downzone
to a lower density. The development includes 3- and 4-plex ranch-style townhomes
intended for sale and not rental. All internal streets will be private and maintained by a
homeowners association. He reviewed landscape buffer areas and building exterior
elevations. Council Member Crone noted that the proposed pond was quite large and asked
if there were any plans to stock it for fishing; Mr. Deets replied that it would be a private pond
and it was not anticipated to be stocked. Council Member Lyon praised the diversity of
textures and colors proposed for the building exteriors. Council Member Sinclair asked
about sale price points; Mr. Deets noted that the units would likely sell in the high $200,000s
or low $300,000s. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair.

the resolution; seconded by Council Member Sinclair. Parks & Recreation Director Jermier

reviewed the agreement, noting that a second amendment was anticipated nearer the

13) Resolution:Consideration of approval of a resolution approving purchase agreement
for certain property located within the City of Waukee [205 Ashworth Drive] – Council
Member Lyon moved to approve the resolution; seconded by Council Member Crone.
Development Services Director Deets noted that the City’s bid submittal to purchase the
subject property from Dallas County was accepted. Council Member Crone asked about
plans for the site; Mr. Deets responded that the City would raze the building and clear the
site for a future extension of the trailhead and overflow parking for the adjacent Windfield
Park. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.

(L) Closed Session: Pursuant to Code of Iowa §21.5(1)(c) to discuss strategy with counsel in

that litigation – Council Member Bottenberg moved to close the regular session and enter
closed session pursuant to Code of Iowa §21.5(1)(c); seconded by Council Member Sinclair.
