FORMAT: Resolution SYNOPSIS INCLUDING PRO & CON: The proposed annexation area is directly adjacent to the current City Limits of Waukee and is consistent with the City’s Comprehensive Plan for future expansion. Proposed Resolution PREPARED BY: Brad Deets, Development Services Director REVIEWED BY: PUBLIC NOTICE INFORMATION – NAME OF PUBLICATION: DATE OF PUBLICATION: I4 THE CITY OF WAUKEE, IOWA RESOLUTION 2020- RESOLUTION APPROVING THE VOLUNTARY ANNEXATION OF PROPERTY – PUBLIC SAFETY PROPERTY WHEREAS, the City of Waukee, State of Iowa, is a duly organized municipal corporation, and; WHEREAS, the City of Waukee, Iowa has consented to an Application for Voluntary Annexation for property owned by the City which is located on the east side of T Avenue and approximately one mile north of Hickman Road within Dallas County, Iowa, and shown on the map identified as Exhibit “A” attached hereto and made a part hereof and legally described as follows: LEGAL DESCRIPTION See Exhibit “B” attached hereto and made a part hereof. WHEREAS, such property collectively adjoins the City as required by Chapter 368, Code of Iowa, 2020, and; WHEREAS, all required notification has been carried out pursuant to Chapter 368, code of Iowa, 2020, and; WHEREAS, a public hearing was held concerning said applications and the annexation on April 20, 2020 as required by law. WHEREAS, it is in the best interests of the City and public that said property be annexed to the City of Waukee, at this time. BE IT THEREFORE RESOLVED, by the City Council of the City of Waukee as follows: SECTION 1. The Application for Voluntary Annexation is hereby approved and said property described in Exhibit “B” shall be annexed to the City of Waukee Iowa, in accordance with Chapter 368, code of Iowa, 2020, and such property shall hereinafter become and be part of the City of Waukee, Iowa. SECTION 2. The Mayor and the City Clerk are hereby authorized and directed to prepare and execute all documents necessary for this annexation and are directed to file the same as required by the Code of Iowa. Lyon Ben Sinclair EXHIBIT A MAP OF ANNEXATION AREA EXHIBIT B LEGAL DESCRIPTION OF ANNEXATION AREA Parcel 20-21 of the Plat of Survey recorded in Book 2020 at Page 10061, Dallas County, Iowa and more particularly described as follows: A parcel of land located in a portion of the Southwest ¼ of the Southwest ¼ of Section 20, Township 79 North, Range 26 West of the 5th P.M., Dallas County, Iowa and more particularly described as follows: Beginning at the Southwest corner of said Section 20; thence North 00⁰10’41” West along the West line of said Section 20, 731.77 feet to the Southwesterly Right of Way line of the Raccoon River Valley Trail (formerly The Minneapolis & St. Louis Railroad); thence South 35⁰04’14” East along said Southwesterly Right of Way line, 753.97 feet, thence Southeasterly 143.22 feet along a 22968.31 foot radius curve to the left and said Southwesterly Right of Way line, said curve having a chord which bears South 34⁰50’56” East for 143.22 feet, to the South line of said Section 20; thence North 89⁰40’54” West along said South line, 512.79 feet to the Point of Beginning and including the eastern ½ of the adjoining T Avenue Right of Way (Parcel No. 1220300008). Said Parcel contains 4.31 acres subject to any and all easements of record.
