(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor Clarke at 5:30 p.m. at Waukee City Hall, 230 W. Hickman Rd. and electronically via Zoom pursuant to the electronic meeting provisions of Iowa Code Sections 21.4(1)(b) and 21.8. (B) Pledge of Allegiance (temporarily suspended) (C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members Anna Bergman (electronically), R. Charles Bottenberg (electronically), Chris Crone, Larry R. Lyon (electronically), Ben Sinclair. Absent: None. Also in attendance: City Administrator Tim Moerman, Finance Director Linda Burkhart, Development Services Director Brad Deets, Parks & Recreation Director Matt Jermier, Marketing & Communications Director Summer Evans, Human Resource Director Michelle Lindsay, IT Director Son Le (electronically), Police Lt. Scott Cunningham, City Clerk Rebecca D. Schuett, City Attorney Steve Brick (electronically). (D) Open Forum (E) Agenda Approval – Council Member Lyon moved to approve the agenda; seconded by Council Member Crone. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. (F) Presentations: None (G) Public Hearings: 1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by rezoning and changing certain property therein to modify PD-1, a property known as Painted Woods South – Mayor Clarke opened the public hearing and asked if any written correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets briefly reviewed the zoning application, noting that when the parcel was first zoned in 2018, the PD-1 provisions allowed for numerous R-2 lots along I-80 with smaller lot sizes. In exchange for the smaller lots, certain enhanced architectural elements were required, including a prohibition on vinyl siding. The proposed modification to the PD-1 zoning would allow the use of vinyl siding. Mr. Deets reviewed proposed exterior elevations showing thicker trim and other City staff recommendations to improve visual interest for the structures. The Planning & Zoning Commission recommended approval; however, City staff recommend the council deny the request for inconsistencies with the adjoining Painted Woods South development and because of the concession in 2018 to allow smaller lots. Council Member Lyon asked if the City staff position on the matter was communicated to the Planning & Zoning Commission; Mr. Deets replied in the affirmative. Council Member Lyon then wondered about the possible cost savings to the developer if they used vinyl instead of hardboard siding; Mr. Deets speculated that there would be a $9,000-10,000 upcharge per home for hardboard siding. Council Member Bottenberg asked how frequently the City agrees to modify development standards and then have a developer request additional modifications; Mr. Deets replied that it was not common but noted that there are a few other PD overlays in the community where additional architectural elements have been required in exchange for smaller lot sizes. Council Member Bergman stated that she would abstain from voting on the matter due to a professional conflict of interest. No comments were made by the public in attendance. 2) On the vacation of a portion of a Storm Sewer Easement and a Public Utility Easement [Indi Run Plat 3] – Mayor Clarke opened the public hearing and asked if any written J1B 2 correspondence had been received; City Clerk Schuett replied in the negative. Development Services Director Deets briefly reviewed the vacation proposal, which is necessary due to a modification of lots from single family to duplex units. No comments were made by the public in attendance. (H) Public Hearing Action Items: 1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by rezoning and changing certain property therein to modify PD-1, a property known as Painted Woods South [introduction; first reading]– Council Member Lyon introduced the ordinance and moved to approve the first reading in title only; seconded by Council Member Sinclair. Development Services Director Deets reiterated City staff’s recommendation that the application be denied. Results of vote: Ayes: None. Nays: Bottenberg, Crone, Lyon, Sinclair. Abstentions: Bergman (due to a professional conflict of interest). Motion defeated 0 – 4 – 1. * 2) Resolution: Consideration of approval of a resolution approving the vacation of a portion of a Storm Sewer Easement and a Public Utility Easement [Indi Run Plat 3]– Council Member Crone moved to approve the resolution; seconded by Council Member Lyon. Mr. Deets reviewed the projected LMI funds from City residential TIF districts, adding that those funds could be used as part of a City program to support affordable housing. 7) Winery property maintenance plan – Parks & Recreation Director Jermier discussed general property maintenance, including possible farm leases for the vineyard portion of the property. 8) Interstate 80 report – Public Works Director/City Engineer Koester reviewed Iowa Department of Transportation (IDOT) plans to widen Interstate 80 from 60th St. in West Des Moines to Grand Prairie Pkwy. 9) Affordable housing – Development Services Director Deets provided information on current vacancy waiting periods for some of the existing affordable housing complexes in Waukee, reviewed the Low Income Housing Tax Credit Program, and noted some potential partnership opportunities. Mr. Deets also discussed an option to develop a City-owned residential lot as affordable or transitional housing. 10) 15705 University Avenue rezoning – Development Services Director Deets gave a brief zoning history of the property in question. 11) Central Iowa Water Trail Initiative – City Administrator Moerman noted a regional effort for improvements to water trails, adding that Waukee does not have any real potential for such trails and wondering if there was a benefit to participating in the initiative. Mayor Clarke added that the council will likely have more and similar decisions in the future as Waukee’s regional presence increases. 12) YMCA partnership – Mayor Clarke stated that she and Development Services Director Deets met with representatives of the Greater Des Moines YMCA and Waukee Family YMCA, at which meeting the YMCA requested financial support from the City. Mayor Clarke and Mr. Deets asked them to provide additional information and suggested they also meet with other metro-area 3 entities regarding possible assistance. The council discussed the matter, noting the important work done by the YMCA in the city but also citing specific concerns with any possible contribution. The council agreed to discuss the matter further at a future work session meeting. 13) Monthly COVID-19 financial impact report – Finance Director Burkhart updated the report given at the prior council work session.
