AGENDA ITEM: Consideration of approval of a resolution approving Addendum to Real Estae
Purchase Agreement [1230 S Warrior Lane]
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: On May 15, 2020, the City Council approved a purchase
agreement for the property located at 1230 S Warrior Lane and the property is
set to close on July 2, 2020. The current owners have asked for a ten day
lease back of the house as the home they are purchasing will not close until
after July 2nd.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:

STAFF REVIEW AND COMMENT: The City Attorney has prepared an Addendum to the Real
Estate Agreement for the lease back of the house. Staff has determined the
fair market value of a lease rate for the ten day period.
RECOMMENDATION: Approve the resolution.

RESOLUTION 2020-
RESOLUTION APPROVING ADDENDUM TO RESIDENTIAL PURCHASE
AGREEMENT FOR CERTAIN PROPERTY LOCATED IN THE CITY OF WAUKEE
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND
WHEREAS, the City entered into a Residential Purchase with Kurt Schade and Jana Schade
(collectively the “Sellers”), for certain property locally known as 1230 S Warrior Lane, Waukee,
Iowa which is scheduled to close on July 2, 2020; AND
WHEREAS, the Sellers are desirous of leasing back the property for a period of ten days
following the closing on the property; AND
WHEREAS, the proposed Addendum to Residential Purchase Agreement is attached as Exhibit
“A.”
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee that the
Addendum to Residential Purchase Agreement attached hereto as Exhibit A is approved.
Passed by the City Council of the City of Waukee, Iowa, and approved the 6th day of July 2020.
