SYNOPSIS INCLUDING PRO & CON: Westside Land Company, LLC, is requesting
approval of a final plat for an approximately 46.50-acre subdivision
located north of Interstate 80 and east of R-22/Ute Avenue. The proposed
final plat includes 75 lots for single-family residential development and
one (1) outlot for future townhome development. The developer has
completed extensions of public streets and utilities that will serve the
plat.
FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS:
COMMISSION/BOARD/COMMITTEE COMMENT: The Planning and Zoning
Commission reviewed the request on July 23, 2019, and recommended approval:
Approval of a Final Plat for Painted Woods South Plat 1
Senior Planner, Andy Kass, introduced the request for approval of a final plat for a residential
subdivision as submitted by the applicant West Side Land Company, LLC. The subject property
is generally located north of I-80 and east of R-22/Ute Avenue, containing approximately 46.50
acres.
Mr. Kass explained that the final plat identifies a total of 75 lots for single family residential
development and one outlot for townhome development. Lots 1-26 are zoned R-1, Single Family
Residential; Lots 27-75 are zoned R-2/PD-1, One and Two Family Residential with a Planned
Development Overlay; and Outlot T is zoned R-4, Row Dwelling and Townhome. He explained
that all lots meet the minimum requirements of the bulk regulations. There are several outlots.
Outlot U is for parkland dedication and Outlots X and Y are intended for storm water
management. Outlot V is subject to the I-80 corridor preservation area imposed by the Iowa
Department of Transportation. This is land that may be acquired by the IDOT for future
improvements to Interstate 80.
Staff recommended approval of the final plat subject to any remaining staff comments, review of
the legal documents and completion of public improvements.
Commissioner Streit asked who is responsible for maintaining Outlot V. Mr. Kass
explained that the IDOT would be responsible for maintaining that outlot.

There was discussion amongst the commission in relation to access off of Prairie Bluff
Drive and the slope on the Kum & Go property. Commissioner Hoifeldt asked if the
vacant Kum & Go property is zoned agricultural. Mr. Kass stated that it is.
Commissioner Ward asked who is responsible for putting in the trail. Mr. Kass explained
that the trail is the responsibility of the developer to install.
Commissioner Hoifeldt asked if the park would be accessed off of the cul-de-sac. Mr.
Kass explained that there would be a public access to the park off of the cul-de-sac.
Commissioner Tietz verified that the green area shown on the south side of the site is a
landscape buffer. Mr. Kass confirmed that it is a landscape buffer.
Commissioner Hoifeldt moved to approve the final plat for Painted Woods South Plat 1 subject to
any remaining staff comments, review of the legal documents and completion of public
improvements. The motion was seconded by Commissioner Tietz. Ayes: Ward, Tietz, Streit,
Hoifeldt, and Koshy. Nays: None. Motion Carries.
STAFF REVIEW AND COMMENT: Staff would recommend approval of the final plat.
RECOMMENDATION: Approve the resolution.

APPROVING THE FINAL PLAT FOR PAINTED WOODS SOUTH PLAT 1
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, Westside Land Company, LLC, has requested final plat approval of Painted Woods South
Plat 1 (the “Plat”); AND,
WHEREAS, the City of Waukee Planning and Zoning Commission recommended approval of the Plat on
July 23, 2019, subject to remaining staff comments and review of the legal documents; AND,
WHEREAS, the Final Plat for Painted Woods South Plat 1 and the documents relating thereto will comply
with Section §303 - Land Subdivision Ordinance of the Waukee Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Waukee, Iowa on this 6th
day of July, 2020, that the Final Plat for Painted Woods South Plat 1 be and the same is hereby accepted
and approved by the City Council of the City of Waukee.
BE IT FURTHER RESOLVED that the City of Waukee does hereby accept the following easements and
documents to be filed with the Plat:
1. Warranty Deed (Outlot Z);
2. Warranty Deed (Lots A, B, and C);
3. Public Utility Easement;
4. Sanitary Sewer Easement;
5. Snow Storage Easement;
6. Overland Flowage Easement;
7. Landscape Buffer Easement;
8. Storm Sewer Easement;
9. Water Main Easement;
10. Painted Woods South Storm Water Management Facility Maintenance Covenant and
Permanent Easement Agreement; and
11. Public Facilities and Use Easement.

HISTORY
The subject property is located north of Interstate 80 and east of R-22/Ute Avenue. In 2018, the Planning & Zoning
Commission and City Council approved a preliminary plat for the property.
PROJECT DESCRIPTION
LOTS
The preliminary plat identifies a total of 75 lots for single family residential development and one (1) outlot for
townhome development. Lots 1 – 26 are zoned R-1 (Single Family Residential) and range in size from 16,119 square feet
to 52,449 square feet. All lots meet the minimum lot width of 80 feet. Table 1 below summarizes the bulk regulations
for the R-1 zoning district.

Lots 27 – 75 are zoned R-2 (One & Two Family Residential) / PD-1 (Planned Development Overlay) and range in size
from 7,150 square feet to 16,745 square feet. During the rezoning a planned development overlay was approved on
these lots to allow for deviations from the standard R-2 requirements with respect to lot area, width, and side yard
setback. All lots meet or exceed the minimums set forth in the planned development. Table 2 below compares that
standard R-2 requirements with those approved with the rezoning.

Outlot T is zoned R-4 (Row Dwelling & Townhome District) and is 8.47 acres in area. Development of this lot will
require additional site plan approval from the Planning & Zoning Commission and the City Council.
Outlot V along the south side of the property is zoned R-4 (Row Dwelling & Townhome District), R-2 (One & Two
Family Residential) / PD-1 (Planned Development Overlay), and R-1 (Single Family Residential) and is 2.50 acres in area.
Outlot V is subject to I-80 corridor preservation area imposed by the Iowa Department of Transportation (IDOT). This
is land that will be acquired by IDOT for future improvements to Interstate 80.
Outlot U in the southeast corner of the development is to be dedicated to the City to satisfy parkland dedication
requirements and is 2.47 acres in area.
Outlots X and Y are intended for storm water management purposes. These outlots will be owned and maintained by a
homeowner’s association.
STREETS AND TRAIL
The final plat identifies extensions of Prairie Bluff Drive and Indian Ridge Drive. In addition, three new streets, Dakota
Circle, Cheyenne Court, and Cherokee Court will be constructed as part of the public improvements.
An 8-foot-wide trail will be included along the south side of Prairie Bluff Drive to provide access to the future park and
future greenbelt trail system. All other areas will have 5-foot sidewalks.
UTILITIES
Public utilities have been extended throughout the plat to service each lot. Storm water detention will be provided
within Outlots X and Y.
STAFF RECOMMENDATION
All proposed lots meet the minimum requirements of the Zoning Ordinance and Planned Development Agreement. The
final plat is in general conformance with the Subdivision Ordinance. Staff recommends approval subject to remaining staff
comments, review of the legal documents, and completion of public improvements.
