AGENDA ITEM:Consideration of approval of Change Order No. 4 to Caliber Concrete, LLC,
for the Fox Creek Park Phase 2 Project decreasing the contract in the amount
of $13,375.33.
FORMAT:Consent Agenda
SYNOPSIS INCLUDING PRO & CON: Change Order No. 4 to Caliber Concrete decreasing the
contract in the amount of $13,375.33 reflects cost adds to correct items
identified during the Building Official’s code review and state inspection,
sealing the parking lot joints, additional sodding along the entrance drive into
the park, and the stripping of previously installed splash pad surface and
sealer and install new tough coat surfacing. Change Order No. 4 also includes
a decrease in the contract amount for the removal of weeps from tunnel, credit
for unused drain tile, shrubs and grasses that were not installed, lack of rebar
in splash pad, and liquidated damages and extra architectural fees.
Representative from Genus and City Staff have reviewed the quantities and
find them to be accurate.

Final Payment Application No. 11
Change Order #4
Dear Mr. Jermier:
Final payment application No.11 includes all work completed on
the project, less retainage. At this time, the contractor has
completed the project in substantial conformance with the plans
and specifications and acceptance of the project is
recommended.
Change order No. 4 adjusts the contract for splash pad tuff coat
application, absence of rebar in the concrete and liquidated
damages associated with additional time for project oversight due
to prolonged construction.
We recommend approval of change order No. 4 and payment of
$64,531.29 to Caliber Concrete, LLC. We also recommend
acceptance of the project and release of retainage of
$157,769.73 after 30 days if no claims have been received.
Once approved, please send one copy to the contractor along
with payment and send one copy to my attention. If you have any
