(A) Call to Order – The regular meeting of the Waukee City Council was called to order by Mayor
Clarke at 5:30 p.m. in the Council Chambers at Waukee City Hall, 230 W. Hickman Rd.
(B) Pledge of Allegiance
(C) Roll Call – The following members were present: Mayor Courtney Clarke; Council Members
Anna Bergman (electronically), R. Charles Bottenberg, Chris Crone, Larry R. Lyon, Ben Sinclair.
Absent: None.
Also in attendance: Development Services Director Brad Deets, Public Works Director/City
Engineer Rudy Koester, Parks & Recreation Director Matt Jermier (electronically), Human
Resources Director Michelle Lindsay (electronically), IT Director Son Le (electronically), Police
Lt. Jeremy Long, Police Officer Rod Schettler, City Clerk Rebecca D. Schuett, City Attorney
Steve Brick.
(D) Open Forum – David Leonard, 210 Northview Dr., stated that he encountered several City of
Waukee firefighters at Fareway earlier in the day and none of the firefighters were wearing
masks. Mr. Leonard believes it sets a terrible example and is a sign of disrespect to others. He
added that he contacted Fire Chief Clint Robinson about the matter and was told there was no
policy on wearing masks. Mr. Leonard advocated strongly for such a policy. Mayor Clarke
replied that she had also received an email from Mrs. Leonard about the matter, adding that the
City is taking a number of steps in an effort to combat COVID-19 but that some of those steps
may not yet have reached all City employees.
(E) Agenda Approval – Council Member Lyon moved to approve the agenda, tabling Consent
Agenda Item I1L until the next regular council meeting; seconded by Council Member
Bottenberg. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0.
(F) Presentations: None
(G) Public Hearings:
1) On an ordinance to amend Chapter 169, Zoning Ordinance, City of Waukee, by
rezoning and changing certain property therein from A-1 to R-2 and R-4, a property to
be known as Autumn Valley – Mayor Clarke opened the public hearing and asked if any
written correspondence had been received; City Clerk Schuett replied that she had not
received any direct correspondence but that Mayor Clarke had forwarded her two emails and
a petition on the matter. Development Services Director Deets reviewed the City’s
comprehensive plan for the area in question, which shows a combination of single family and
multi-family development. He clarified that the comprehensive plan is a guide for
development and subject to change. He also reviewed plans for future street extensions,
including 10th St. The rezoning applicant has provided the City with a concept plan for the
parcel, showing single family lots and townhome development. Mr. Deets noted that the
concept shows a different alignment for 10th St. than indicated in the comprehensive plan.
He added that the rezoning application was approved by the Planning & Zoning
Commission, but that the Commission wanted to see the impact of aligning 10th St. further to
the east. Seth Moulton, representing applicant D.R. Horton, addressed the council and
stated that realignment of 10th St. would move it closer to existing single family homes. The
applicant has considered single family homes along 10th St. but was told that driveway
access off that street is not allowed. The applicant had also considered donating the
townhome portion east of 10th St. to the City as parkland but was told it was considered too
small a parcel for a park. Mr. Moulton noted that the townhomes would be three bedroom
units for people looking for a starter home.

Mayor Clarke asked for public comment: 1) Nicolas Stumbo, 865 9th St., voiced his objection
to the rezoning, stating that he and many of his neighbors moved into the area believing that
the comprehensive plan would be followed. Townhomes in the area would not align with that
plan. He added that he would rather have 10th St. where originally planned and that the
townhome parcel east of 10th St. would be better developed as a park, allowing children
access without having to cross a major street. Mayor Clarke asked for clarification from staff
on parks in the area; Mr. Deets replied that the parcel in question would create more of a
“pocket” park if so developed and that the City has already acquired property further to the
west for the development of a larger park with trail connections for access. 2) Matt
Patterson, 855 9th St., voiced his objection to the rezoning, adding that while he understood
the comprehensive plan was not set in stone, he believed townhomes would be a drastic
change from that plan. He noted that neighbors were not given much time to respond to the
rezoning request, then echoed Mr. Stumbo’s comments that 10th St. along his backyard
would be preferred to townhomes. He also noted that one of the property owners who
signed off on the rezoning request was the property seller, which he believed was a conflict
of interest. He asked the council to do what the neighbors request and not just what the
developer wants to do. He concluded by noting an existing shortage of park space in the
City. Mayor Clarke clarified that the council was considering the zoning and not the site
plan. 3) Kelli Hansen, 865 8th St., agreed with Mr. Stumbo and Mr. Patterson, adding that as
the area has developed a lack of park space has become apparent and that the larger park
planned to the west would require crossing 10th St. to access. She asked the council to
consider the concerns of neighboring homeowners. 4) Steve Kiburz, 770 Gray Ave., said
that he and his family moved to their home due to its proximity to schools and Waukee’s
development standards. While he knew the area in question would be developed, he and
his neighbors appear to have received conflicting information as to how it would develop. He
noted that the applicant (D.R. Horton) has not received good online reviews, which is
concerning. He would like his area’s covenants extended to the subject parcel. He also
voiced concern with increased traffic and subsequent safety, and encouraged a park as a
better option for the neighborhood. 5) Kay Murphy, 950 9th St., echoed what others had said
as part of her objection to the rezoning, agreeing that if given the choice between
townhomes or 10th St. along her backyard, she would choose the street. She added that
allowing townhomes would open up the area for additional medium-density housing. 6) Josh
Nuss, 846 9th St., noted that he had moved to his home from an area with townhomes, which
created a lot of traffic and brought strangers to the area. He believes townhomes would lead
to additional, similar development and negatively impact property values. 7) Trey Eason,
900 Gray Ave., stated that he also formerly lived near multi-family development and that
such areas can start off nice but can deteriorate quickly. He added that he was told the area
in question wouldn’t develop for five years, while others had been told ten years. 8) Jon
Raftis, 965 9th St., did not believe the townhomes should be approved, at least on the east
side of 10th St. He added that his objections were nothing personal against Mr. Moulton or
Mr. Deets, but the rezoning is a personal matter to him.
Council Member Bottenberg agreed with the Planning & Zoning Commission in wanting to
see alternative configurations of 10th St. While he believes there is a certain level of luck
involved when building next to undeveloped areas, he also believes that the area residents
have a good argument that the City will follow the comprehensive plan. He noted that it was
a powerful statement that neighbors would rather have a four-lane road in their backyards
than townhomes, but such issues need to be balanced with development concerns. He
added that his vote tonight might not be his final vote on the matter. Mr. Moulton again
addressed the council, stating that an alternate concept plan was provided to the City and
showed townhomes only on the west side of 10th St. He added that they were open to
solutions and that there was no hidden agenda to including townhomes on the east side of
10th St. Mr. Deets answered that his office had received the revised concept plan but had
some concerns with it.

9) Branden Stubbs with Stubbs Engineering noted that his firm drafted the concept plan and
that they had presented multiple concepts to City staff. The one currently before the council
was considered to be what was best for the neighbors, as the developer did not know that
neighbors would prefer a four-lane road in their backyards. Council Member Crone asked if
one of the concepts was for single family homes along 10th St.; Mr. Stubbs replied in the
affirmative, but noted that driveway access is not allowed along 10th St. Mayor Clarke said it
appeared that there was much discussion still to be had on the matter. Council Member
Lyon stated that he would vote in favor of the first reading to keep the conversation going but
that he will watch the matter closely as it moves forward. Council Member Bergman agreed
with much that had already been said, adding that straying too far from the comprehensive
plan is not a good idea and that she also has concerns with the development. She stated
that she would vote against the rezoning tonight but is open to seeing alternative plans prior
to additional ordinance readings. She concluded by noting an apparent lack of
communication between the developer and residents. Mr. Deets stated that much of what is
currently proposed agrees with the comprehensive plan, other than the location of 10th St.
He again reviewed the overall comprehensive plan for the area. 10) Ashley Kiburz, 770
Gray Ave., expressed concern with how commercial development is planned in the area,
noting that how it is laid out now will cause problems in the future. Council Member Sinclair
asked why the area to the far west of the townhome parcel was not shown as developed on
the concept plan; Mr. Stubbs replied that the area was designated for parkland and storm
water detention. Council Member Sinclair then asked if parkland to the east of 10th St. was
something the developer would consider; Mr. Stubbs replied in the affirmative, if the City
would accept the parcel. Mayor Clarke reiterated that only the zoning was currently under
consideration and not the site plan. She agreed that the City needs more green space,
citing parkland development as one of the council’s top priorities, but that parkland doesn’t
always develop immediately. Mr. Stumbo again addressed the council, asking for additional
information on why 10th St. was proposed to move from the original planned orientation; Mr.
Deets replied that the City would agree with either alignment but added that 10th St. will carry
a lot of traffic in the future, perhaps similar to University Ave.
2) On a proposed Amendment No. 3 to the Waukee Consolidated Urban Renewal Plan in
the City of Waukee, State of Iowa – Mayor Clarke opened the public hearing and asked if
any written correspondence had been received; City Clerk Schuett replied in the negative.
Development Services Director Deets briefly reviewed the urban renewal plan amendment,
which updates development projects identified in the plan, including public improvement
projects for which TIF revenue can be used for financing. No comments were made by the
public in attendance.
(H) Public Hearing Action Items:
1) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, by rezoning and changing certain property therein from A-
1 to R-2 and R-4, a property to be known as Autumn Valley [introduction; first reading]
– Council Member Bottenberg introduced the ordinance and moved to approve the first
reading in title only; seconded by Council Member Lyon. City Attorney Brick explained that
any rezoning application that is denied cannot be brought forward again for a year. He
added that many of the concerns brought up during the public hearing, such as 10th St.
alignment, would be addressed during the platting process. Council Member Bottenberg
asked how amended legal descriptions would impact the ordinance approval process; Mr.
Brick replied that the matter would need to go before the Planning & Zoning Commission
again if a road realignment impacted the zoning legal descriptions. Council Member
Bottenberg reiterated that he would vote in favor of the first reading, with the hope that some
progress is made on the alignment of 10th St. and on possible parkland. Results of vote:
Ayes: Bottenberg, Crone, Lyon, Sinclair. Nays: Bergman. Motion carried 4 – 1.
2) Resolution: Consideration of approval of a resolution determining an area of the City
to be an economic development area, and that the rehabilitation, conservation,
redevelopment, development or a combination thereof, of such area is necessary in
the interest of the public health, safety or welfare of the residents of the City;

designating such area as appropriate for urban renewal projects; and adopting the
Amendment No. 3 to the Waukee Consolidated Urban Renewal Plan – Council Member
Lyon moved to approve the resolution; seconded by Council Member Crone. Results of
vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.

the City of Waukee, Iowa [introduction; first reading] – Council Member Bottenberg
introduced the ordinance and moved to approve the first reading in title only; seconded by
Council Member Sinclair. Public Works Director/City Engineer Koester noted that the
proposed ordinance was one of the phased steps in traffic calming measures along SE
Waco Pl. Results of vote: Ayes: Bergman, Bottenberg, Crone, Lyon, Sinclair. Nays: None.
Motion carried 5 – 0.
3) Ordinance: Consideration of approval of an ordinance to amend Chapter 502, Waukee
Municipal Code, Traffic Regulations of the City of Waukee, Iowa, by amending Section
502, Parking Regulations, certain public street as specified (SE Waco Place)
[introduction; first reading] – Council Member Crone introduced the ordinance and moved
to approve the first reading in title only; seconded by Council Member Lyon. Public Works
Director/City Engineer Koester noted that the proposed ordinance was another of the
phased steps in traffic calming measures along SE Waco Pl. Mayor Clarke asked when the
ordinance would go into effect; Mr. Koester reviewed the process, adding that City staff were
working on a communications plan for the area, as well. Results of vote: Ayes: Bergman,
Bottenberg, Crone, Lyon, Sinclair. Nays: None. Motion carried 5 – 0.
4) Ordinance: Consideration of approval of an ordinance to amend Chapter 169, Zoning
Ordinance, City of Waukee, by rezoning and changing certain property therein from C-
4/PD-1 to C-4 and C-1A, a property addressed as 15705 University Avenue [second
reading] – Council Member Lyon moved to approve the second reading of the ordinance in
title only; seconded by Council Member Sinclair. Development Services Director Deets
reminded council of concerns brought up during the public hearing regarding possible,
specific uses for the C-1A parcel. The proposed ordinance now includes restrictions on
petroleum and auto parts sales. In correspondence, the developer is agreeable to the
amendment. Council Member Bottenberg stated that he would recuse himself from the vote
due to a professional conflict of interest. Results of vote: Ayes: Bergman, Crone, Lyon,
Sinclair. Nays: None. Abstentions: Bottenberg. Motion carried 4 – 0 – 1.
