HomeMy WebLinkAbout2020-08-03-I03 Waco Pl Speed Limit_2ND-3RD READAGENDA ITEM: CITY OF WAUKEE, IOWA CITY COUNCIL MEETING COMMUNICATION MEETING DATE: August 3, 2020 AGENDA ITEM:Consideration of approval of an ordinance to amend Chapter 501, Waukee Municipal Code, regarding the speed limit on SE Waco Place within the city limits of the City of Waukee, Iowa [second, third (final) readings] FORMAT:Ordinance SYNOPSIS INCLUDING PRO & CON: FISCAL IMPACT INCLUDING COST/BENEFIT ANALYSIS: COMMISSION/BOARD/COMMITTEE COMMENT: STAFF REVIEW AND COMMENT: In order to implement the changes sooner and in light of no public comment on the matter, City staff recommends approval of the second reading of the ordinance in title only and waiver of the third reading. The Code of Iowa requires a vote of not less than three-fourths of all the members of the council (or 4 out of 5, in Waukee’s case) in order to waive readings of an ordinance. RECOMMENDATION: Approve the second reading of the ordinance in title only, waive the third reading and place the ordinance on final passage. ATTACHMENTS: I. WHEREAS, the City has conducted an engineering and traffic investigation on Waco Place, from E Hickman Road to SE Laurel street; and WHEREAS, based on the study, the City Council of the City of Waukee has determined that the speed limit should be changed on certain portions of SE Waco Place within the City of Waukee. BE IT THEREFORE ORDAINED by the City Council of the City of Waukee: Section 1: Chapter 501, Waukee Municipal Code, Regulation of Traffic Upon and Use of the Streets of Waukee, Iowa, is hereby amended by changing Section 501.9(F)(10) as follows: §501.9(F)(10) The speed limit on Waco Place, from E Hickman Road to SE Laurel street, shall be 30 MPH Section 2 Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3. Severability Clause. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provisions or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
