AGENDA ITEM: Consideration of approval of a resolution approving Satisfaction of
Agreement for Public Improvements for Westgate Business Park Plat 2
FORMAT: Resolution
SYNOPSIS INCLUDING PRO & CON: Staff has received a request to satisfy a development
agreement as it pertains to the completion of public improvements within
Westgate Business Park Plat 2. The public improvements were completed and
accepted by the City several years ago.
Approval of the satisfaction of the agreement will clean up title for future
acquisitions of property within Westgate Business Park Plat 2.

STAFF REVIEW AND COMMENT: Staff would recommend approval of the resolution
RECOMMENDATION: Approve the resolution.

RESOLUTION 2020-
APPROVING SATISFACTION OF DEVELOPMENT AGREEMENT FOR PUBLIC
IMPROVEMENTS – WESTGATE BUSINESS PARK PLAT 2
IN THE NAME AND BY THE AUTHORITY OF THE CITY OF WAUKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized
Municipal Organization; AND,
WHEREAS, Eastpark Development, LLC and Valley Paper, Inc. entered into a Development
Agreement, filed November 27, 2000 and recorded in Book 2000 Page 12289 in the office of
the Recorder of Dallas County, Iowa (the “Agreement”)
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa
that the terms of the Agreement have been satisfied by all parties and the City releases
Eastpark Development LLC and Valley Paper, Inc. and their successors and assigns, from all
obligations under said Development Agreement as it relates to the following property:
WESTGATE BUSINESS PARK PLAT 2
Passed by the City Council of the City of Waukee, Iowa, and approved this the 17th day of
August, 2020.
